12.08.010 Improvement procedure.

Whenever the owners of property adjoining any street in the city, or any other such owners, may desire to have such street graded, or otherwise improved or leveled, and such owners or any other persons or either or both shall, by private donation, raise a fund therefor, or shall express their willingness to perform labor upon or furnish material to be used in the grading or otherwise improving such street, it shall be lawful for such owners or persons, or a majority thereof, to agree as to the manner in which such fund shall be expended, labor performed or material used, and to do such grading and make such other improvements, or to employ any person or persons, firm, company or corporation to do the same; provided, before any such grading or improvement shall be commenced, the person, firm, company or corporation or, if a number of persons, then a committee or agent appointed by them or a majority of them, undertaking the same shall notify the public works director of the city of the intention to do such grading or make such improvement, and the same shall be done under and according to the directions and approval of the public works director, according to requirements of “City of Castle Rock Development Guidelines and Public Works Standards.” Finish grade shall match existing grade as near as possible. Improving shall in no case be a charge upon the city. [Amended during 2009 recodification; Ord. 38 § 1, ca. 1892].
