17.56.010 Abandonment and discontinuance of nonconforming uses.

When a nonconforming use is:

A. Discontinued for a consecutive period of one year; or

B. Discontinued for any period of time without a present intention to reinstate the nonconforming use;

the property involved may thereafter be used only for conforming purposes. [Ord. 2018-02 § 2 (Exh. A), 2018].

17.56.030 Repairs, maintenance and reconstruction.

Minor repairs to and routine maintenance of property where nonconforming situations exist are permitted and encouraged. Major renovations, i.e., work estimated to cost more than 40 percent of the appraised valuation of the structure to be renovated, may be done only in accordance with a building permit issued pursuant to this section. 17.56.035 Damage restoration permitted when.

Nothing in this title shall be deemed to prohibit the restoration of a building starting within one year from the date of its destruction to the extent of its replacement value and existing foundation, by fire, explosion, act of God or act of public enemy, or prevent the continuance of the use of such building or part thereof. 17.56.040 Completion of nonconforming projects.

All nonconforming projects on which construction was begun at least 180 days before the effective date of the ordinance codified in this chapter as well as all nonconforming projects that are at least 10 percent completed in terms of the total expected cost of the project on the effective date of the ordinance codified in this chapter may be completed in accordance with the terms of their permits, so long as these permits were validly issued and remain unrevoked and unexpired. If a development is designed to be completed in stages, this section shall apply only to the particular phase under construction. [Ord. 2018-02 § 2 (Exh. A), 2018].

17.56.050 Exemptions.

Notwithstanding any other provision of this title, whenever the city or other authorized governmental authority, as a result of the acquisition of right-of-way by purchase or condemnation, causes any lot or plots of ground to become nonconforming as to the yard requirements, building site dimensions, and off-street requirements as set forth in this title, such yard requirements, building site dimensions and off-street parking requirements shall not be applicable.
