17.76.010 Definitions.

As used in this chapter:

A. “Commission” means the planning commission of the city.

B. “Council” means the city council.

C. “Petition” means the direct petition method of annexation as contained in RCW 35.13.130, as now adopted or hereafter amended, as differentiated from the election method described in Chapter 35.13 RCW. [Ord. 2018-02 § 2 (Exh. A), 2018].

17.76.020 Adoption of state law.

Any land lying contiguous to the city may be annexed to the city under any of the methods provided in Chapters 35.13, 35A.05 and 35A.14 RCW, as now adopted or hereafter amended, which chapters are adopted herein by reference and made a part hereof as though fully incorporated. 17.76.030 Petition method.

The initiating party shall submit the annexation request to the city council and will meet with the city council at their next regularly scheduled meeting to review the geographic scope of the proposed annexation as set forth in Chapter 35.13 RCW. [Ord. 2018-02 § 2 (Exh. A), 2018].

17.76.040 Petition – Presentation – Commission recommendation.

The completed annexation petition is submitted by the council to the city planning commission who shall determine the proper zoning classification, comprehensive plan and map classification for proposed annexation area.

The planning commission shall hold a public hearing on the annexation request and forward their written findings and recommendations to the city council. [Ord. 2018-02 § 2 (Exh. A), 2018].

17.76.050 Petition – Hearing.

The council shall, after receiving the written recommendation of the commission, hold a public hearing for the following purposes:

A. To determine whether such land, or any portion thereof, as so zoned should be annexed to the city;

B. Review urban service area and urban growth boundary;

C. Upon acceptance of the annexation, the city council shall file a notice of intention to annex with the Cowlitz County boundary review board as per requirement of RCW 36.93.090. [Ord. 2018-02 § 2 (Exh. A), 2018].

17.76.060 Ordinance passage.

Upon receipt of the final action of the boundary review board and the council determines in favor of annexing such land, under such zoning classification or classifications, it shall cause such request to be placed on a ballot for a vote by all persons of voting age residing within the area to be annexed into the city. Upon receipt of a majority vote in favor of annexation the council shall by ordinances annex and zone the area. [Ord. 2018-02 § 2 (Exh. A), 2018].

17.76.070 Filing fee.

In addition to the requirements of this chapter any application seeking the annexation of any property to the city shall be accompanied by a filing fee, which shall be nonrefundable, as defined in CRMC 17.08.020. Such filing fee shall be payable at the time the application is presented to the council for consideration and is levied to offset the administrative, publication, copying, postage and other miscellaneous costs applicable to the processing of the application.
