16.08.010 Adopted.

The certain document, three copies of which shall be on file in the office of the city clerk, the same being marked and designated as “Lewis County Shoreline Management Master Program” prepared by the Lewis regional planning commission, is adopted as the Shoreline Management Master Program for the city of Centralia and each and all of the regulations, provisions, penalties, conditions and terms of such “Lewis County Shoreline Management Master Program” as modified in this chapter are adopted and made a part hereof as if fully set out in this chapter. (Ord. 1388 § 1 (part), 1977).

16.08.015 Amendments.

A.  The Lewis County Shoreline Management Master Program, as adopted by CMC 16.08.010, is amended so that the sentence “Residential development within the identified floodway is prohibited.” is substituted for the sentence “Residential development in areas of identified flooding is prohibited.” whenever such latter sentence is found within said Lewis County Shoreline Management Master Program. (Ord. 1512 § 2, 1982).

16.08.020 Duties by city engineer.

Those functions and duties assigned to the Lewis County planning department in the said “Lewis County Shoreline Management Master Program” shall be undertaken for the city of Centralia by the city engineer’s office and those functions and duties assigned to the director, Lewis County planning department are to be undertaken for the city of Centralia by the city engineer. (Ord. 1388 § 1(A), 1977).

16.08.030 Notice requirements followed.

In addition to the notice requirements set forth on page 72 of said “Lewis County Shoreline Management Master Program” the additional notice requirements of RCW 90.58.140(4), as now in force or as hereafter amended, shall be followed. (Ord. 1388 § 1(B), 1977).

16.08.040 Review period replaced.

The “45-day state review period” set forth on page 72 of said “Lewis County Shoreline Management Master Program” is replaced by the applicable review period now in force or as hereafter amended under and by virtue of the laws of the state of Washington. (Ord. 1388 § 1(C), 1977).

16.08.050 Wetlands and wetland areas defined.

The definition of “Wetlands” or “Wetland Areas” as set forth on page 71 of said “Lewis County Shoreline Management Master Program” is modified to read as follows:

19.  “Wetlands” or “Wetland Areas” means those lands extending landward for two hundred feet in all directions as measured on a horizontal plane from the ordinary high water mark; floodways and contiguous floodplain areas landward two hundred feet from such floodways; and all marshes, bogs, swamps and river deltas associated with the streams, lakes, and tidal waters which are subject to the provisions of RCW 90.58, PROVIDED HOWEVER, notwithstanding any provision herein to the contrary, the only portion of the one-hundred-year-flood plain to be included in this master program is the floodway and the adjacent land extending landward two hundred feet therefrom as said floodways are or may be indicated on the U.S. Corps of Army Engineers and U.S. Department of Agriculture-Soil Conservation Service maps on file in the office of the Centralia City Engineer.

16.08.060 Exemptions.

Any exemptions provided under Chapter 90.58 RCW are likewise to be exempt hereunder. (Ord. 1388 § 1(E), 1977).

16.08.070 Other terms incorporated by reference.

Any terms, provisions, definitions or other procedures of Chapter 90.58 RCW, so long as not inconsistent herewith, are hereby incorporated herein by this reference. (Ord. 1388 § 1(F), 1977).

16.08.080 Maps adopted by reference.

Those certain maps on file in the office of the city engineer, one of which is designated as the FEMA Flood Insurance Rate Map (FIRM) and the other as the FEMA Flood Boundary And Floodway Map (both such maps, for identification purposes only, bearing the notation “Effective June 1, 1982”), be and the same hereby are adopted by this reference, along with any future amendments thereto, and made a part hereof for the purpose of administering the provisions of this chapter. (Ord. 1512 § 1, 1982: Ord. 1388 § 2, 1977).

16.08.090 Compliance with additional requirements.

Nothing in this chapter shall be construed to relieve any person, firm or corporation of any additional or further requirements of any city, county, state or federal laws including but not limited to the requirements of the State Environmental Policy Act (SEPA). (Ord. 1388 § 3, 1977).

16.08.100 Violation—Penalty.

In addition to and notwithstanding any other provisions hereof, violations of this chapter are declared to be misdemeanors subjecting any person, upon conviction therefor, to a fine not to exceed five hundred dollars. Each person violating any provision of this chapter shall be deemed guilty of a separate offense for each day during which said violation continues. (Ord. 1388 § 5, 1977).
