1.390.010 Designation of agent for receipt of filing of a claim.

The auditor shall be the authorized agent to receive filing of all claims for damages pursuant to RCW 4.96.020 as that law currently exists or as it may hereafter be amended. The designated agent’s identity and address are as follows:

1.390.020 Business hours and time limits.

The auditor’s office hours are nine a.m. to five p.m., Monday through Friday each week. The auditor’s office is closed on Saturdays, Sundays, and all holidays as defined in RCW 1.16.050, as that statute currently exists and as may be hereafter amended. All claims for damages against Chelan County and/or any of its agents, officers, employees, or volunteers shall be presented in writing to said agent during office hours and within the applicable period of limitations within which an action must be commenced. 1.390.030 Claim form—Content and mode of delivery.

All claims for damages presented to the designated agent must be in writing and contain at a minimum:

(1) The claimant’s name, date of birth, and contact information;

(2) A description of the conduct and the circumstances that brought about the injury or damage;

(3) A description of the injury or damage;

(4) A statement of the time and place that the injury or damage occurred;

(5) A listing of the names of all persons involved and contact information, if known;

(6) A statement of the amount of damages claimed; and

(7) A statement of the actual residence of the claimant at the time of presenting the claim and at the time the claim arose;

(8) All claims must be signed either:

(A) By the claimant, verifying the claim;

(B) Pursuant to a written power of attorney, by the attorney-in-fact for the claimant;

(C) By an attorney admitted to practice in Washington state on the claimant’s behalf; or

(D) By a court-approved guardian or guardian ad litem on behalf of the claimant.

All claims for damages against Chelan County and/or any of its agents, officers, employees, or volunteers shall be presented in writing. A claim is deemed presented when the claim form is delivered in person or is received by the agent by regular United States Postal Service mail, registered mail, or certified mail, with return receipt requested, to the agent or other person designated to accept delivery at the agent’s office. Claims delivered by facsimile or electronic mail are not accepted.
