2.04.010 Definitions.

Definitions in this chapter shall be the same as those enumerated in the Revised Code of Washington 68.04.010 to 68.04.240, inclusive. (§ 1 of Res. 159-D, April 29, 1957 at Vol. A page 624, 625).

2.04.020 Plat of cemetery.

Every cemetery authority within Chelan County established after the effective date of this chapter shall, before filing a plat of the proposed cemetery, submit to the Chelan County Planning Commission, a true copy of said plat. This plat shall contain an accurate scale description of the proposed cemetery, showing all lots to be sold, placement of shrubberies, flower beds, monuments, irrigation systems, roads and pathways and shall be in compliance with Chapter 10.08, also it shall include land embracing ten or more acres. This plat is to be followed in the construction of said cemetery and if any later major deviations from the plat are to be made, a plat containing said changes shall be submitted to the Chelan County Planning Commission, in advance of the changes and approved by the said Commission. 2.04.030 Endowment care cemeteries—Must have five or more developed acres before sale.

Any cemetery established after the effective date of this chapter shall be an endowment care cemetery within the provisions of the Revised Code of Washington 68.40.010 to 68.40.090 or as the Washington State Legislature may hereinafter amend the statutes relating to endowment care cemeteries. The cemetery shall have five or more acres of land developed before they commence sales of lots within the cemetery, except as herein provided. Provided, that sales may be made if less than five acres are developed if a bond, approved by the Chelan County Prosecuting Attorney, in the amount of $25,000.00 shall be filed with the Chelan County Auditor. This bond is to be conditioned upon the proper development of the cemetery in accordance with the filed plat, and if in the opinion of the Chelan County Commissioners the cemetery has not been developed according to the plan filed in the Chelan County Auditor’s office then the said bond shall be forfeited to the County, and shall be used to maintain the said cemetery. 2.04.040 Access roads.

The cemetery shall have adequate access road leading to and from the cemetery property on to the public road and shall be so situated that there shall not be created any traffic congestion or hazard. The Planning Commission shall be satisfied that property so selected shall not impede any potential rights of way, public or private. (§ 4 of Res. 159-D, April 29, 1957 at Vol. A page 624, 625).

2.04.050 Water must be adequate to maintain plant life—Drainage.

Before there is issued a permit for a cemetery the Chelan County Planning Commission shall be satisfied that there is adequate water, irrigation or domestic, to maintain the plant life shown upon the submitted plat. The cemetery authority shall also provide for adequate drainage. The said drainage conditions and system to be passed for approval or disapproval by the Chelan County Health Officer or his deputies. 2.04.060 Fencing or hedging required.

The cemetery property is to be enclosed by either fencing or hedging or similar and suitable manner to prevent animals, wild or domestic from coming upon the property. (§ 6 of Res. 159-D, April 29, 1957 at Vol. A page 624, 625).

2.04.070 Office of cemetery authority—Permit—Chapter does not apply to certain cemeteries.

The cemetery authority shall maintain an office within the County and have an agent of the cemetery authority within the County.

When the Chelan County Planning Commission is satisfied that the above requirements have been met, or provided for, they may then issue a permit as provided in Chapter 11.04 of this code.

This chapter shall not apply to any bona fide religious corporation, church, religious society or denomination or any cemetery organized, controlled, and operated by any of them, or any county, town or city cemetery. (§ 7 of Res. 159-D, April 29, 1957 at Vol. A page 624, 625).
