16.02.010 Short title.

This title, and amendments thereto, shall be known and may be cited as the Chelan County “enforcement and violations resolution.” (Res. 2020-137 Att. A, 12/8/20; Res. 2003-67 (part), 5/20/03).

16.02.020 Scope.

The provisions of this chapter shall apply to enforcement of the Chelan County shoreline master program and the following county codes as now or hereafter amended: Title 3 (Building Regulations); Title 11 (Zoning); Title 12 (Subdivisions); Title 13 (Environment); Title 15 (Development Standards); and county-adopted city ordinances as applicable. 16.02.030 General purpose.

All violations of this title and all applicable titles, statutes, and regulations are hereby declared to be detrimental to public health, safety, and welfare and are hereby declared to be public nuisances. Each day or portion of a day upon which a violation occurs or continues constitutes a separate violation. This title declares certain acts to be civil violations and establishes nonpenal enforcement procedures and civil penalties. (Res. 2020-137 Att. A, 12/8/20; Res. 2003-67 (part), 5/20/03).

16.02.040 Statement of goals.

It is the intent of Chelan County to proactively prevent code violations through education. Where violations have been documented, compliance with the code may be pursued through administrative remedies and voluntary compliance as a first step. When warnings and voluntary compliance efforts have been unsuccessful, compliance may be pursued with civil penalties to ensure uniform and efficient application of the code. (Res. 2020-137 Att. 16.02.045 Remedies not exclusive.

The remedies set forth in this title are not exclusive. Nothing in this code limits or restricts the authority of the county to pursue other lawful criminal, civil or equitable remedies to abate, discontinue or correct violations. The county is authorized to institute any appropriate action or proceeding to prevent or remedy any violations. (Res. 2020-137 Att. A, 12/8/20; Res. 2018-30 (Att. A) (part), 4/10/18).

16.02.050 Severability.

If any section, subsection, paragraph, sentence, clause, or phrase of this title is, for any reason, held to be invalid or unconstitutional, such invalidity or unconstitutionality shall not affect the validity or constitutionality of the remaining portions of this title which will remain in full force and effect.
