5.50.060 Notice of applicability.
(A) Publication of Notice. The county shall publish a notice of the availability of a summary of this chapter at least once in the county’s official newspaper within thirty (30) calendar days of the effective date of the ordinance codified in this chapter or any amendments to this chapter, and on an annual basis.
(B) Notice to Known Affected Employers. For those employers within the county known to be an affected employer, the county shall send written notice to each known affected employer that they are subject to this chapter. The county shall also send to all known affected employers notice of any amendments to this chapter. This notice shall be sent to the affected employer addressed to the affected employer’s chief executive officer. Such notice shall be delivered within thirty (30) calendar days of the effective date of the ordinance codified in this chapter or any amendments hereto.
(C) Self-Identification. Affected employers that, for whatever reason, do not receive notice within thirty (30) calendar days of the effective date of the ordinance codified in this chapter, shall identify themselves to the county within ninety (90) calendar days of the effective date of the ordinance codified in this chapter. Upon self identification, such affected employers will be granted one hundred eighty (180) calendar days, to develop and submit a CTR program.
(D) Failure to Identify. Affected employers that have not been identified and that do not identify themselves within ninety (90) calendar days of the effective date of the ordinance codified in this chapter are considered in violation of this chapter.
(E) Any existing employer with seventy-five (75) or more employees that obtains a site plan review approval in Clark County, subsequent to the effective date of the ordinance codified in this chapter shall be required to complete a questionnaire that assesses whether or not an employer will be deemed affected or nonaffected in accordance with the provisions of this chapter.
