5.50.170 CTR program review.

(A)    Approval. The county shall send a letter of CTR program approval to all affected employers that submit a CTR program which is deemed acceptable by the county within ninety (90) calendar days of the date the CTR program is submitted. If the affected employer does not receive notice from the county within ninety (90) calendar days of the CTR program submittal date, the CTR program shall be deemed approved.

(B)    Conditional Approval. The county may send notice to the affected employer that its CTR program is approved except for certain aspects of its CTR program that are not acceptable, and therefore, modifications will be required for CTR program approval. A letter of notice, requesting such modifications, will be addressed and sent to the affected employer’s transportation coordinator. Affected employers will be given thirty (30) calendar days from the date of notice to submit a revised CTR program. The county shall have fourteen (14) calendar days to analyze, make a recommendation and respond to the revised CTR program.

(C)    Rejection of CTR Program. The county may send notice to the affected employer that the CTR program is rejected. A letter of rejection will be addressed and sent to the affected employer’s transportation coordinator within ninety (90) calendar days of the CTR program submittal date. The letter will specify the cause(s) for the rejection. The county will schedule a meeting with the affected employer within twenty-one (21) calendar days of the date of notice. During the meeting, the county will provide technical assistance to the affected employer. The affected employer will be given thirty (30) calendar days from the date of the meeting to submit a revised CTR program. The county shall have fourteen (14) calendar days to analyze, make a recommendation and respond to the revised CTR program.

(D)    If a CTR program or revised CTR program is deemed acceptable, the affected employer must begin to implement the approved CTR program immediately upon notice from the county. (Sec. 16 of Ord. 1993-01-21)
