5.50.200 Enforcement.
(A) Compliance. Except as otherwise provided in this chapter, compliance shall mean fully implementing all provisions in an accepted CTR program and satisfying the requirements of this chapter.
(B) Achieving CTR Goals. An affected employer shall include in its CTR program measures designed to achieve the percentage reductions set forth in Section 5.50.140 of this chapter for its affected employees and of all of its full-time employees, if an affected employer chooses to make its CTR program applicable to all of its full-time employees. PROVIDED, however, if an affected employer cannot reduce the VMT’s and SOV’s of its affected employees by the percentages set forth in Section 5.50.140 of this chapter, an affected employer shall be deemed in compliance with this chapter if the employer either:
(1) Demonstrates in writing to the satisfaction of the jurisdiction that it acted in good faith; or
(2) Demonstrates in writing to the satisfaction of the jurisdiction that special characteristics of the affected employer’s business prevents that affected employer from reducing the VMT’s and SOV’s of its affected employees by the percentages set forth in Section 5.50.150 of this chapter. For the purposes of this section, “special characteristics of the affected employer’s business” shall mean those circumstances contained in Sections 5.50.160(A), (B) and (C) of this chapter.
