14.07.010 Applicability.
(1) A grading (excavation, fill, and stockpile) permit is required for land disturbing earthwork activities of fifty (50) cubic yards or more. For the purpose of determining permit applicability, the volume amount includes the total combination of cuts plus fills.
(a) Under fifty (50) cubic yards, a grading permit is not required, provided cuts and fills meet the slope and depth requirements of Section 14.07.050(1)(g) and (h).
(b) Within critical areas, a grading permit is not required for less than fifty (50) cubic yards; however, grading in critical areas may be subject to other federal, state, and county regulations. Critical areas within the county include: flood hazard areas (Chapter 40.420), geologic hazard areas (Chapter 40.430), habitat conservation (Chapter 40.440), wetland protection (Chapter 40.450), and the shoreline overlay district (Chapter 40.460).
(2) Where conflicts occur between the technical requirements of this chapter and the soils report, the soils report shall govern.
