24.12.090 Applications and approval.

(1)    Applications for permits to operate new or existing solid waste handling facilities and disposal sites may be obtained at the office of the jurisdictional board of health and shall be on forms prescribed by the Department of Ecology and the jurisdictional board of health and shall contain a description of the proposed and existing facilities or additional facilities to be constructed, and such other information as the health officer may deem necessary in order to determine whether the solid waste handling facility or disposal site will comply with state law, state regulations and the provisions of this chapter.

(2)    The application shall include either a copy of the conditional use permit issued pursuant to Section 40.260.200 of this code or the applicant’s basis for contending that such a conditional use permit is not required.

(3)    The health officer shall send copies of applications for permits to:

(a)    Clark County community development department;

(b)    Department of Ecology;

(c)    Department of Natural Resources;

(d)    Solid waste advisory commission;

(e)    Any other appropriate city, county, state or federal agency.

(4)    Plan Adherence Required. Any solid waste handling facility or disposal site shall submit a site plan, a plan of operation, a closure and post-closure monitoring and maintenance program, and a site plan showing ultimate use of the site, with the application for a permit; provided, that such plans shall be consistent with any conditional use permit issued pursuant to Section 40.260.200 of this code. Once the permit is granted based upon the site and operations plans as submitted or as modified by the health officer and accepted by the operator of the site or facility, the operation may not be substantially or significantly changed without prior permission from the health officer and, if appropriate, the S.W.A.C., DOE, and the conditional use permit approval authority. The site plan shall not be changed at all, and shall be adhered to strictly in the development and use of the site, except as the health officer may approve of changes in writing which are consistent with the conditional use permit. Significant changes in operations or any change in the site plan made without prior approval are grounds for cancellation of the permit for the site or facility.
