24.17.090 Sewage technologies.

(1)    CCPH will permit only public domain technologies that have DOH RS&Gs and those treatment products and distribution products registered under the requirements of Chapter 246-272A WAC or subsequent revisions.

(2)    The only sewage technologies CCPH will permit are as follows per DOH RS&Gs:

(a)    Public domain technologies (e.g., sand filters);

(b)    Proprietary treatment products (e.g., aerobic treatment systems and packed bed filters including those used for bacteriological reduction registered with the DOH);

(c)    Public domain distribution technologies (e.g., gravel or generic gravel substitutes, gravity and pressure distribution methods and materials); and

(d)    Proprietary distribution products (e.g., subsurface dripline products or gravelless distribution products) approved by the DOH.

(3)    CCPH adopts as guidance all DOH RS&Gs, both current and any future revisions. Every attempt will be made to apply these standards and guidance to system application; design; installation; operation, monitoring and maintenance; performance expectations; and sources of information.

(a)    CCPH may grant variances from RS&Gs when the RS&Gs cannot be adapted to local conditions or where the proposed variance appears to meet or exceed the intent of the RS&G and where no negative public health impacts are expected.

(b)    An explanation of the rationale for such a variance will be documented in the CCPH record.

(4)    CCPH shall not issue product development permits (PDP); only the State Board of Health may issue such permits. (Sec. 10 of Ord. 2007-10-01)
