24.17.250 Quality assurance.

(1)    CCPH will maintain an active quality assurance program in order to provide the level of oversight required by law for the protection of consumers and protection of the public from the potential health risks of improperly sited, designed, installed, or operated OSS systems.

(2)    Designers. Beginning January 1, 2008, designers will provide final inspections on all alternative systems.

(3)    CCPH reserves the authority to provide final inspections of all conventional gravity systems, larger OSSs, Table IX repairs and any systems designated under this chapter. In addition, CCPH will:

(a)    Provide either a complete soil and site evaluation at the request of the property owner, or a concurrency soil/site evaluation (including staking reviews when necessary), in order to ensure that land which will support a conforming OSS is identified before any other investment is made in OSS development.

(i)    When staking is required but building site data is not available to allow it to be done simultaneously with a soil and site evaluation, CCPH will do an additional staking evaluation at a fee designated by the BOH when such data becomes available.

(4)    CCPH-Certified Professionals. CCPH will audit the work of county-certified professionals (pumpers, installers and O&M specialists) through both random site visits and review of electronic reporting data to determine compliance with industry standards, and reserves the right to conduct random audits of designers’ final inspections.

(a)    Inspection of pumper trucks will be carried out once a year.

(b)    Beginning in 2008, random audits will be carried out on ten (10) percent of all jobs performed by CCPH-certified professionals. Baseline findings will determine frequency of subsequent inspections and allow CCPH to work with the professional to identify and resolve performance issues. The field audit schedule may be more or less frequent depending on the professional’s performance.

(5)    CCPH will first and foremost take the approach of working with industry professionals to review deficiencies and develop corrective action plans in order to assist them in understanding how to avoid such violations in the future. However, CCPH maintains the option of addressing ongoing issues through the following actions as well:

(a)    Develop a written corrective action plan with the professional indicating steps they will take to avoid such deficiencies in the future.

(b)    Increase audit frequency.

(c)    For DOL licensed professionals, failure to adhere to these requirements may be grounds for reporting to the Department of Licensing.

(d)    For CCPH-certified professionals, consistent failure to adhere to these requirements may be grounds for suspension, revocation, or denial of renewal of the CCPH-issued certification:

(i)    Any installer or O&M specialist working on systems for which he or she is not certified, violating conflict of interest policies, or defrauding or attempting to defraud a customer or CCPH, will have their certification immediately revoked.

(ii)    Persons contesting the results of a decision may request an informal review by the program manager, or may request a hearing in accordance with the regulations in this chapter. (Sec. 26 of Ord. 2007-10-01)
