15.36.010 Adopted.

This chapter adopts the 2018 Washington State Energy Code, as written by the Washington State Building Code Council, specifically including WAC 51-11R and WAC 51-11C. [Ord. 1652 § 1, 2021; Ord. 1600 § 1, 2018; Ord. 1112 § 1, 1991.]

15.36.020 Conflict.

Whenever any conflict occurs between any section of the Clarkston Municipal Code and the code referred to in CMC 15.36.010, the code shall prevail. [Ord. 1112 § 4, 1991.]

15.36.030 Severability.

If any section or provision of this chapter of the energy code or its application to any person or circumstance is declared unconstitutional or invalid for any reason, such decision shall not affect the validity of the remaining portions of this chapter. [Ord. 1112 § 2, 1991.]

15.36.040 Penalties.

Notwithstanding any and all reference to penalties contained within the 2018 Washington State Energy Code, the penalties for each violation of any term and/or condition and/or requirement of this chapter shall be a civil infraction, as defined in CMC 1.01.110(1)(a), and for each violation shall be fined an amount of $150.00. For a second infraction of the same provision occurring within a 12-month period, the amount of the penalty that may be forfeited shall increase to $200.00. For a third and subsequent infraction of the same provision within a 12-month period, the amount of the penalty that may be forfeited shall increase to $250.00. Each day that a violation exists shall be a separate and distinct violation. [Ord. 1652 § 2, 2021; Ord. 1600 § 2, 2018.]
