12.26.010 Permit--Required.

It is unlawful for any person, firm or corporation to use, distribute, display, explode or burn any type of fireworks within any city park at any time without first obtaining a permit as required in this chapter. (Ord. 1155 §1, 1983).

12.26.020 Permit--Authority to issue.

The chairman of the board of park commissioners, or his designee, may issue a permit to use, distribute, display, explode or burn such fireworks in the city parks. (Ord. 1155 §2, 1983).

12.26.030 Permit--Issuance procedures.

The board of park commissioners may establish other appropriate rules, regulations and procedures for the issuance of park fireworks permits consistent with this chapter. Every application fee for a park fireworks permit shall include a twenty-five dollar clean-up and damage deposit, which shall be returned to the applicant upon satisfactory proof that the respective fireworks area has been properly cleaned and that no damage has occurred. The park fireworks applicant shall assume personal responsibility for the cleanup and any damages to the park which occur as a result of the fireworks. (Ord. 1155 §3, 1983).

12.26.040 Violation--Penalty.

Any person, firm or corporation violating any of the provisions of this chapter shall be guilty of a civil infraction, and upon a finding of a violation shall be fined not more than two hundred fifty dollars plus restitution to the city of Colfax for cleanup and damage. Each violation of this chapter constitutes a separate offense. (Ord. 1155 §4, 1983).
