2.100.010 Creation of board.
There is created a board of park and recreation commissioners, consisting of seven members, who shall be appointed by the mayor with the consent of the majority of the city council. Two council members (one for the parks department and one for the recreation department and community center) shall be appointed to serve as nonvoting advisory members of the board. (Ord. 1104 NS § 1, 1995).
2.100.020 Term of office – Filling vacancies.
A. The terms for each position shall be four years; provided, however, the first commissioners shall determine by lot whose term of office shall expire each year. Initially, two positions shall expire December 31, 1995; two shall expire December 31, 1996; two shall expire December 31, 1997; and one position shall expire December 31, 1998. Vacancies on the board shall be filled in the same manner and shall be for the unexpired portion of the term.
B. One of the above positions shall be filled with a person who resides outside of the Colville city limits but within the boundaries of Colville School District No. 115. (Ord. 1104 NS § 2, 1995).
2.100.030 Officers – Quorum – Meetings.
Officers of the board shall consist of a chairman, vice chairman, and such other officers as may be necessary. Officers shall be elected in January of each year. A recording secretary may be allowed by the board either from within or without its own membership. It shall be the duty of the chairman to preside at all meetings of the board and of the secretary to keep official minutes of all meetings and of all proceedings of the board unless a recording secretary is appointed. A majority of the board shall constitute a quorum for the transaction of business, and a majority vote of those present shall be necessary to carry any proposition. Meetings of the board shall be scheduled at least once each month. The board shall fix the time and place of its meetings. The meetings of the board shall be public. Special meetings of the board may be called by the chairman or upon 24-hour notice signed by four members of the board. (Ord. 1104 NS § 3, 1995).
2.100.040 Removal of board member.
Any member of the board may be removed from office by the mayor with the approval of a majority of the city council. The absence of any member from three consecutive regular meetings of the board may result in the board member’s removal upon request by the mayor and confirmation by council. (Ord. 1104 NS § 4, 1995).
2.100.050 Powers and duties generally.
The board shall have all of the powers and perform all the duties necessary and incidental to its operation. The board shall have power to plan any form of recreation or cultural activity that will employ the leisure time of the people in a constructive and wholesome manner, including overseeing the operation of the community center, and may:
A. Plan, promote and develop within the city limits, parks, squares, parkways and boulevards, play and recreation grounds, and/or other municipally owned recreation facilities including community buildings, and improve and ornament the same;
B. Exercise censorship over any statuary, monuments or works of art presented the city for use or exhibit in parks or recreation areas;
C. Solicit and receive on behalf of the park and recreation board, park department, city swimming pool, recreation department or community center any gifts or bequests of money or other personal property or any donation to be applied, principal and income, for either temporary or permanent use for playgrounds, parks, or other recreational purposes, the same to be deposited with the city treasurer to be used exclusively for park and recreational purposes;
D. Grant concession privileges to be exercised on parks and recreation property of the city, the revenue from which shall be used for parks and recreational purposes; provided, however, that no concession or privilege shall ever be granted for the sale of any intoxicating liquors, beer and/or wine in any public park, unless specifically approved by the city council, and then only to a licensed franchise.
The park superintendent or recreation coordinator is authorized to issue single day concession permits as per terms established by the board upon confirmation of necessary permits;
E. Fix charges for the use of any municipally owned or controlled park or recreation facility, including community center activities;
F. The park superintendent, the recreation coordinator, and other city employees are responsible for administration decisions and implementation of the programs and the board shall not assume those functions. Any disputes regarding responsibilities, powers and duties shall be resolved by the city council;
G. Advise department heads accordingly for the orderly and efficient management of the parks and recreation facilities of the city. (Ord. 1104 NS § 5, 1995).
2.100.060 Budget and fiscal powers and duties.
The department heads at a regular meeting shall review the parks, recreation and swimming pool budget requests. The board shall make recommendations and advise department heads as needed. (Ord. 1104 NS § 6, 1995).
2.100.070 Rules and regulations – Promulgation and effect – Violation.
A. Rules and regulations adopted by the board under the authority herein granted, upon formal adoption by ordinance by the city council, shall be promulgated by filing a copy thereof with the city clerk, by posting a copy thereof on the bulletin board in the lobby of City Hall for not less than five days prior to the regulation taking effect, and by having a copy available for public review in the parks and recreation office.
B. Any person who shall willfully and intentionally violate any such ordinance shall be guilty of a misdemeanor.
C. Any standing policies set before creation of the ordinance codified in this chapter shall stand in effect. (Ord. 1104 NS § 7, 1995).
2.100.080 Compensation.
The members of the board shall receive no salary; however, when the board determines that it is desirable for members to attend a state, regional or national conference dealing with park and recreation issues, it may recommend the attendance and payment of the actual expenses involved in attending such meetings through requests in the annual budget. If approved in the annual budget, reimbursements for these expenditures shall be allowed as per the same policies as for all other city travel. (Ord. 1104 NS § 8, 1995).
2.100.090 Park and recreation employees.
The mayor shall be the appointing and discharging authority for the employees of the city engaged in park and recreation activities. The board may make recommendations to the mayor concerning the appointment and discharge of such employees. (Ord. 1104 NS § 9, 1995).
2.100.100 Board decisions – Appeal to city council.
A. All decisions of the board of park and recreation commissioners shall be final unless, within 15 days of the date of the decision, a party affected by the decision appeals the action, in writing, to the Colville city council. Included in the document shall be all facts pertaining to the appeal.
B. Any matter properly submitted to the city council on appeal as herein provided shall be heard de novo. (Ord. 1104 NS § 10, 1995).
