8.28.020 Amendments.
The ordinance codified in this article is adopted in accordance with the provisions of RCW 35.21.180 and all amendments and additions to the Revised Code of Washington sections enumerated in the ordinance codified in this article, when printed and filed with the city clerk shall be considered and accepted as amendments and additions to the ordinance codified in this article. (Ord. 998 NS § 3, 1988).
8.28.030 Copies of adopted statutes on file.
Prior to adoption of the ordinance codified in this article, three copies of the sections enumerated in this article have been filed in the office of the city clerk for use and examination by the public. (Ord. 998 NS § 4, 1988).
8.28.040 Violation – Penalty.
Any person, firm, corporation or association violating any of the provisions of this article shall be deemed guilty of a misdemeanor or gross misdemeanor as provided in this article and shall be subject to a fine of not more than $500.00 and/or imprisonment in the county jail for a term of not in excess of 90 days. (Ord. 998 NS § 5, 1988).
Article II. Regulations Effective 1993
8.28.050 Hours for sale of fireworks.
Only common fireworks as defined in Chapter 70.77 RCW (otherwise known as “safe and sane”) are legal for sale to the public. The sale of any fireworks prior to 9:00 a.m. July 1st or after 7:00 p.m. July 4th is prohibited. This chapter shall be effective for the calendar year 1993 and subsequent years. (Ord. 1049 NS § 1, 1992).
8.28.060 Use of fireworks – Discharge restrictions.
The use or discharge of fireworks is limited within the city limits of the city to only July 4th from 9:00 a.m. to 11:00 p.m., and the same time periods for July 4th of subsequent years. (Ord. 1049 NS § 2, 1992).
8.28.070 Display of regulations at point of sale required.
Any vendor licensed by the city to sell common fireworks shall display a copy of the ordinance set out in this article in a prominent place at the point of sale. (Ord. 1049 NS § 3, 1992).
8.28.080 Violation – Penalty.
Persons violating or failing to comply with any of the sections of this article shall be guilty of a misdemeanor and shall be punished by a maximum of 90 days in jail and/or a $1,000 fine. The court shall not suspend or defer $200.00 of the fine absent proof of indigence. (Ord. 1049 NS § 4, 1992).
