10.28.010 Definitions.
No off-road and/or non-highway vehicles, as defined by Chapter 46.09 RCW, may be operated on the streets and alleys of the city without:
A. Being properly licensed pursuant to RCW 46.09.040; and
B. Holding a permit issued by the chief of police for the city. (Ord. 1033 NS § 1, 1991).
10.28.020 Permits.
The chief of police of the city shall issue permits for street use of qualifying off-road and/or non-highway vehicles as follows:
A. Upon payment of a fee as shall be set by the city police department, in an amount of not less than $15.00;
B. Said permit shall be valid for a calendar year, ending December 31st of each year;
C. No permits shall be issued unless the vehicle is equipped with:
1. Headlights, tail-lights and a warning flag, as designated by the chief of police of the city;
2. A slow-moving emblem; and
3. An orange safety strobe light. (Ord. 1033 NS § 2, 1991).
10.28.030 Compliance with local and state traffic laws.
All vehicles with valid permits may be operated on the streets and alleys of the city, as set forth below; provided, however, that all such vehicles are subject to all state and local traffic rules and regulations, and shall obey all statutes and ordinances regarding the rules of the road; and provided further, that all such vehicles shall be operated with the safety strobe in operation, the safety emblem affixed and the headlights and tail-lights activated. (Ord. 1033 NS § 3, 1991).
10.28.040 Use of city streets – Snow removal only.
Such vehicles shall not use city streets except for the purpose of snow removal, including access to or from city streets. (Ord. 1033 NS § 4, 1991).
10.28.050 Use of city streets – Prohibited where.
No off-road or non-highway vehicle shall be permitted to use the following streets of the city: Main Street, Highway 395, Third Street, Hawthorne, or Birch Street, except at intersections to cross same. (Ord. 1033 NS § 5, 1991).
10.28.060 Violations.
Any violation of this chapter shall be an infraction punishable by a fine not to exceed $250.00; provided, however, that nothing herein shall be construed to limit or restrict the penalty of an offense charged under any other state statute or city ordinance. (Ord. 1033 NS § 6, 1991).
