LOW-INCOME SENIOR CITIZEN OR LOW-INCOME DISABLED CITIZEN

(a)  For the purpose of applying the provisions of the codes and ordinances of the city, the qualifications for “low-income senior citizen” or “low-income disabled citizen” are as follows:

(1)  The individual must be either (A) sixty-two years of age or older at the time of applying, or (B) at the time of application qualify for special parking privileges under RCW 46.16.381(1)(a) through (f); or a blind citizen as defined in RCW 74.18.020; or developmentally disabled as defined in RCW 71A.10.020; or a mentally ill person as defined in RCW 71.05.020; and

(2)  The individual must be the sole occupant or the head of a household or the spouse of the head of the household, and the “combined disposable income,” as the term is defined in RCW 84.36.383, of all persons residing in the household is designated below:

(A) Class A Designation. A combined annual household income which does not exceed ten thousand dollars,

(B) Class B Designation. A combined annual household income which exceeds ten thousand dollars, but is less than fifteen thousand dollars.

(b)  An individual desiring low-income senior citizen status or low-income disabled citizen status must make annual application therefor at Connell city hall. The application will require submission under oath of information on the age of the applicant and the household income. In addition, the city clerk-treasurer shall require copies of the Federal Income Tax Return for the applicant, the applicant’s spouse and all other persons living in the residence, and a copy of the special identification card issued by the state of Washington, Department of Licensing, which identifies a person as being entitled to special parking privileges. The applicant shall provide such other data and information as deemed appropriate and upon forms and in a manner determined by the city clerk-treasurer.

(c)  Determination of eligibility shall be made by the city clerk-treasurer based upon information provided by the applicant.

(d)  Upon approval of the application, the individual shall be entitled to such reduced rates, fees and other benefits as may be provided by the Connell Municipal Code beginning on the fifteenth day of the month following the application date through April 15th of the following year.

(e)  Where differences of opinion exist regarding this chapter and the implementation thereof, the city council shall make the final determination.

(f)  Any person signing a false claim or making false representations in order to secure reduced rates, fees and other benefits available by virtue of low-income senior citizen status or low-income disability citizen status, shall be guilty of a misdemeanor.
