7.16.020 Definitions.

When used in this chapter, the following words and expressions shall have the meanings ascribed to them below:

(a)    “Health officer” means the health authority of the Benton-Franklin District Health Department or his authorized representative;

(b)    “Person” means any natural person, firm, corporation, partnership, association, or agency of state, county, or municipal government, or agency of the federal government which is subject to the jurisdiction of the state. (Ord. 417 § 2, 1978).

7.16.030 Permit required.

It is unlawful for any person to operate a food service establishment or temporary food service establishment without having in his possession an unrevoked permit issued by the health officer as hereinafter provided. (Ord. 417 § 3, 1978).

7.16.120 Business license.

The city of Connell shall issue no business license to any person to operate a food service establishment, until such person has been issued a permit by the health officer as herein provided, and if such permit is suspended or revoked by the health officer, the business license of such person shall be likewise suspended or revoked. 7.16.130 Injunction.

If any person operates a food service establishment in violation of the terms of this chapter, in addition to the other remedies and penalties herein provided, the city of Connell may petition the Franklin County superior court for a temporary restraining order or permanent injunction against such person. 7.16.140 Designation of health department.

The Benton-Franklin County health department is designated as the official health department for the city of Connell. (Ord. 850 § 3 (Exh. C) (part), 2009: Ord. 417 § 16, 1978).

7.16.150 Violations—Penalties.

Any person, firm, corporation or association violating or failing to comply with any of the provisions of this chapter shall be deemed guilty of a misdemeanor and upon conviction thereof shall be punished by a fine in a sum not exceeding one thousand dollars or by imprisonment in the jail for a period not to exceed ninety days or by both such fine and jail.
