14.24.010 Conditions for issuance.

No building permit shall be issued by the building inspector of the city, for the construction, erection, or placement of a building upon unplatted land, that is, land which is located in an area for which a plat or subdivision has not been filed with the county auditor, pursuant to RCW 58.08.020, until or unless the following conditions are fulfilled:

(1)    Applicant for such building permit shall submit to the building inspector a scale drawing of the building site area upon which is detailed the nearest dedicated streets and public roads on at least two sides of said building site, and upon which is detailed the proposed streets and alleys and/or utility easements to serve the occupants of said proposed building;

(2)    Applicant shall submit to the building inspector a proposed dedication deed for proposed streets and alleys and/or utility easements to serve the occupants of said building. (Ord. 918 § 1 (part), 2012: Ord. 900 § 1 (part), 2011: Ord. 268 § 1, 1970).

14.24.020 Application to planning commission.

Every application for a building permit for the construction, erection or placement of a building upon unplatted land in the city shall be referred to the planning commission of the city, together with the scale drawing of said building site and the proposed dedication deed for the streets and alleys and/or utility easements. 14.24.030 Issuance.

If the planning commission is satisfied that suitable provisions have been made by the applicant for the dedication of streets, alleys and/or utility easements which shall conform in layout to existing streets, alleys and/or utility easements, the planning commission shall authorize the building inspector to issue said building permit, subject to such reasonable conditions and requirements as said commission shall require, including the recording of the dedication deed or deeds for adjacent streets, alleys or easement. 14.24.040 Two permit limit—Waiver.

No more than two successive building permits shall be issued for the construction, erection or placement of a building upon unplatted lands, unless a special waiver is obtained from the planning commission upon a showing of extraordinary or unusually peculiar circumstances. Such waiver shall be discretionary with the planning commission. Otherwise, the planning commission shall direct that the building area be platted in accordance with RCW 58.08.020. 14.24.050 Lien—Foreclosure.

In addition to other penalties, the city may enjoin the person from continuing the construction or improvement, and cause such improvements to be removed at the expense of the offending person, and if such expense is not paid, the city may file a lien therefor against the land and foreclose the same, in any manner allowed by the laws of the state of Washington.
