1.01.010 Adoption.

The Cross Valley Water District Code, as compiled from the resolutions of Cross Valley Water District, and edited and published by Code Publishing Company of Seattle, Washington, is adopted as the official code of Cross Valley Water District. [Res. 2015-6-2 § 1.]

1.01.020 Title – Citation – Reference.

This code shall be known as the “Cross Valley Water District Code” and it is sufficient to refer to said code as the “Cross Valley Water District Code” or the “CVWDC” in any proceeding at law or equity. It is sufficient to designate any resolution adding to, amending, correcting or repealing all or any part or portion thereof as an addition to, amendment to, correction or repeal of the Cross Valley Water District Code. Further reference may be had to the titles, chapters, sections and subsections of the Cross Valley Water District Code and such references shall apply to that numbered title, chapter, section or subsection as it appears in the code. 1.01.030 Title, chapter and section headings.

Title, chapter and section headings contained in this code shall not be deemed to govern, limit, modify or in any manner affect the scope, meaning or intent of the provisions of any title, chapter or section of this code. [Res. 2015-6-2 § 3.]

1.01.040 Interpretation.

The following rules of interpretation and application shall apply to this code:

(1) Wherever reference is made to gender, gender includes the masculine, feminine and neutral genders.

(2) The singular shall include the plural and the plural shall include the singular.

(3) Present tense shall include the past and the future tenses and vice versa unless stated otherwise or manifestly inapplicable.

(4) Whenever any act or omission is made unlawful by this code, it shall include causing, allowing, permitting, aiding, abetting, suffering or concealing the fact of such act or omission.

(5) Whenever a time within to act is set forth in this code, the time shall be computed by excluding the first day and including the last day, unless the last day is a Saturday, Sunday or a holiday, in which case the last day shall be the next regular business day. [Res. 2015-6-2 § 4.]

1.01.050 Reference applies to all amendments.

Whenever a reference is made to this code as the “Cross Valley Water District Code” or to any portion thereof, or to any resolution of Cross Valley Water District, the reference shall apply to all amendments, corrections and additions heretofore, now or hereafter made. [Res. 2015-6-2 § 5.]

1.01.060 Reference to specific resolutions.

The provisions of this code shall not in any manner affect matters of record which refer to, or are otherwise connected with, resolutions which are therein specifically designated by number or otherwise and which are included within the code, but such reference shall be construed to apply to the corresponding resolution provisions contained within this code. 1.01.070 Effect of code on resolutions – Future resolutions.

The adoption and provisions of this code shall not be construed as affecting the validity of any resolution of Cross Valley Water District or any provision thereof and the language of a resolution shall prevail in the event of any conflict. Not all resolutions of Cross Valley Water District are adopted in this code; and the general manager shall determine which resolution or provision thereof will be added to this code and shall update the code not less frequently than annually. The determination not to include any resolution or provision thereof in this code shall not affect the validity or effect of said resolution or provision. [Res. 2015-6-2 § 7.]

1.01.080 Effect of code on past actions and obligations.

Neither the adoption of this code nor the repeal or amendment hereby of any resolution or part or portion of any resolution of Cross Valley Water District shall be construed as a waiver of any interest, right, obligation, license, or fee at said effective date, nor be construed as affecting any of the provisions of such resolution and all rights and obligations thereunder appertaining shall continue in full force and effect. 1.01.090 Severability.

If any section, subsection, sentence, clause or phrase of this code is for any reason held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining portions of this code. The board of commissioners declares that it would have passed this code, and each section, subsection, sentence, clause and phrase thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases had been declared invalid or unconstitutional, and if for any reason this code should be declared invalid or unconstitutional, then the original resolution or resolutions shall be in full force and effect.
