CIVIL INFRACTIONS

8.22.010 Violation.

A. A violation of any of the provisions of this chapter shall be a civil infraction.

B. A person found to have committed an infraction under this chapter may be assessed a monetary penalty of up to $250.00 for each offense. In lieu of payment of all or part of the monetary penalty, the court may provide for the performance of community service. (Ord. 04-05 § 1, 2004)

8.22.020 Urinating in public.

A. A person shall be found to have committed a violation of this section if the person intentionally urinates or defecates in a public place, other than a washroom or toilet room, or at a place and under circumstances where such act could be observed by any member of the public.

B. For the purposes of this section, “public place” means an area generally visible to public view and includes streets, sidewalks, bridges, alleys, plazas, parks, driveways, parking lots, automobiles (whether moving or not), and buildings open to the general public including, but not limited to, those which serve food or drink, or provide entertainment, and the doorways and entrances to buildings or dwellings and the grounds enclosing them.
