2.37.040 Classifications of activities.
The following categories of activities for users of the Ellensburg Youth and Community Center are hereby established. These rates are adopted for uses which are in addition to regularly scheduled city activities and meetings, or other city business, for which there are no charges:
A. Category I. Free, broad-based community events with direct benefit to the community as a whole, with community-wide interest and involvement, e.g., a major public forum or nonprofit community festival. These events must have broad community involvement. Youth-oriented events in this category are especially encouraged.
B. Category II. Public meetings; educational, recreational and cultural programs; meetings and activities of nonprofit groups, of educational entities, of community organizations and of local government agencies.
C. Category III. Private noncommercial events; state and federal government agencies; group activities of commercial entities not selling a product or service, e.g., private parties and celebrations.
D. Category IV. Convention and trade shows; activities of commercial entities selling a product or service on a one-time or occasional basis. [Ord. 4280, 2001.]
2.37.080 Fees and charges.
A. The schedule of hourly rates for the Ellensburg Youth and Community Center (all rentals include use of restrooms) is:

B. Daily fees shall not exceed the appropriate hourly rate multiplied by eight, unless hours used exceed 10. If more than 10 hours are used, the rate shall be multiplied by 10.
C. All categories will also pay the following, where applicable:
1. Equipment setup/take down: $2.50 minimum; rate of $10.00/hour charged in 15-minute periods.
2. Staff person to supervise facility use, as determined necessary by the center coordinator or parks and recreation directer, per person per hour: $10.00.
3. Use of recreational equipment and games upon prior approval by the center coordinator or parks and recreation director, per event: $25.00.
4. Cleaning/trash disposal fee may be levied when meals are served: $50.00. (For parties or banquets; may also be charged when center requires extra cleaning after an event.)
5. Security/damage deposit if there is reason to believe damages could result from an event: $200.00.
D. Equipment Use. All other center equipment and furnishings are available for client use in the center without additional charge. Equipment is not rented to persons or groups using other facilities.
City of Ellensburg employees may request short-term loans of equipment for use in other department facilities when it is not scheduled for use in the center.
E. Scheduling Conflict Policy. If scheduling conflicts occur, center staff and the director shall try to resolve these problems through rescheduling or referral to other facilities. If this does not resolve the problem, a decision will be made based on the following: Regularly scheduled city activity, meeting, or other regular city business, which event was booked first, appropriateness to the primary and secondary uses of the center, numbers of users, and amount of revenue generated. Primary uses are those which achieve the purposes of youth and/or community recreation-based functions. Secondary uses are those which are permissible according to the terms of state law and this chapter. [Ord. 4280, 2001.]
2.37.120 Business license required.
City business license requirements shall apply for any event in Category IV. In addition, out-of-state businesses need to obtain a license to do business in Washington State. [Ord. 4280, 2001.]
2.37.140 Director's authority to set other fees.
The parks and recreation director is authorized to establish other rates and fees necessary for programs, activities and special events at the Ellensburg Youth and Community Center for which rates and fees have not been established in this chapter. The director shall advise the city council, through the city manager, of any such rates and fees established under this authority. [Ord. 4280, 2001.]
2.37.160 Waiver of fees.
A. The parks and recreation director shall have authority to waive any of the fees provided for in this chapter in accordance with the following fee waiver criteria:
1. All fee waiver requests must be in writing and on or accompanying a city of Ellensburg parks and recreation fee waiver request form.
2. Waiver requests with a cash value of up to but not exceeding $150.00 must be submitted to the parks and recreation director for approval/ denial.
3. Waiver requests will be considered only from not-for-profit agencies, institutions, organizations and associations exclusively engaged in or devoted to religious, charitable, scientific, literary, educational, public or other like work, and the event for which a fee waiver is requested must be open to public participation.
4. Only one request per calendar year may be granted to any particular nonprofit entity.
5. The parks and recreation director will provide the city manager an annual accounting of fee waivers granted to qualifying entities, including the cash value of each waiver.
B. Waiver requests with a cash value exceeding $150.00 must be submitted to the city council for approval/denial. In its consideration of such requests, the city council will apply the criteria set forth in subsection (A) of this section. [Ord. 4344, 2002.]
