3.04.120 Powers and duties of mechanical inspector.
A. The city manager shall appoint a competent person as mechanical inspector.
B. The mechanical inspector and assistants are authorized, empowered and directed to inspect and supervise the installation, construction, reconstruction and repair of all house gas piping, gas appliances, fixtures and apparatus now or hereafter to be placed in or in any manner directly attached to any building or structure within the city of Ellensburg and other buildings and structures to which gas utility service is being furnished by the city. The mechanical inspector and assistants shall be subject to the orders and directions of the city manager of the city and they are vested with full authority to enter any building or premises at any reasonable time in the discharge of their duties herein imposed.
C. It shall be the duty of the inspector to receive all applications for connection of mechanical systems within the city, to pass on and approve or reject plans submitted, to issue permits for all gas plumbing work, extensions, or change in location of fixtures; to sign and issue all notices and to keep a daily record of all applications received, plans approved and all other matters which may pertain thereto and to make a monthly report of his operations to the city manager of the city.
D. The inspector shall inspect as often as necessary all installations in the course of erection, alteration or repair and to inspect any mechanical equipment or gas plumbing of any character already in use which the inspector may have reason to believe is out of repair or unsafe.
E. The inspector shall give the owner or agent in charge of any building written notice of any defects in his plumbing or fixtures or changes or repairs necessary and such owner or agent shall within five days after such notice make necessary changes or repairs. If the owner or agent fails to comply with this notice, the mechanical inspector may order the energy service and/or public works departments to turn off the gas, electricity and/or water and it shall not thereafter turn said utilities on again until the mechanical inspector has certified that such defects have been repaired or removed.
F. The mechanical inspector shall furnish the gas division of the energy services department with a copy of each certificate of inspection. The division shall not turn gas on to any new or altered or repaired system of gas until such certificate has been received.
G. It shall also be the duty of the inspector to investigate all alleged violations of the provisions of this chapter and to file complaints when necessary. No one except the city shall at any time turn any valve or cock or in any way tamper or make any connection with any gas main, meter, meter connection or gas service pipe between the main and the meter. 3.04.160 Mechanical contractor's bond and licenses.
Every contractor, before entering upon the installation, construction, reconstruction or repair of any mechanical system in the city of Ellensburg's corporate limits, shall show proof of bonding equal to that required by the State of Washington Department of Licensing, conditioned that the principal therein shall faithfully comply with the terms of this chapter and which shall indemnify and hold harmless the city of Ellensburg and other persons for all losses, costs, expenses, damages and injuries sustained by the city or such persons as a result of the principal, agent, or employee's failure to comply faithfully with the terms of this chapter doing work in the city of Ellensburg. 3.04.200 Property owner's responsibility.
No property owner shall cause or permit any installation, construction, reconstruction or repair of any mechanical system in the city before the person so doing the work shall have first obtained a permit from the city to do such work; and the mere fact that the work has been done will be considered sufficient to hold and render the property owner amendable to this rule. 3.04.240 Applications for permits.
A. An owner or agent must obtain a mechanical permit for the installation, replacement, or repair of any mechanical and/or heating equipment new or used, when a vent, duct work, or piping of any type is disconnected or reconnected. A permit is not required for the installation or removal of an appliance where only the listed appliance connector and/or listed electrical plug is all that is necessary to activate the appliance in accordance to the manufacturer's installation instructions and/or the International Mechanical Code.
B. Before the construction, reconstruction, installation or repair of any mechanical system, suitable plans and specifications of all the work proposed to be done, showing clearly the sizes of pipe, kind of fittings, locations and measurements, made out on blueprints or the application form and properly signed by the owner, owner's agent, or other authorized representative and filed at the office of the building department of the city of Ellensburg.
C. Any licensed contractor working without a permit shall be subject to the following restrictions:
1. First offense, written warning;
2. Second offense, fine not to exceed $100.00;
3. Third offense, license suspended for one year;

3.04.480 Test, inspection and certificate of inspection.
A. When piping has been installed in accordance with International Mechanical Code requirements for an installation, whether the same be new construction, repairs, extensions, or alterations, the same must be inspected and tested in the presence of the mechanical inspector or assistant and a certificate of inspection issued as provided in this chapter. Such test shall be made in accordance with International Mechanical Code requirements.
B. No fire test or water test shall be permitted on gas house piping and water-tested piping will be condemned as faulty.
C. When the mechanical system and all alterations thereto have been firmly closed, and if found tight the person installing the system shall notify the mechanical inspector for an inspection. Upon receiving notification, the inspector or assistant will schedule a time for the inspection of the installation and shall witness the test, and if found tight and the work done in accordance with the provisions of the International Mechanical Code and this chapter, then the inspector or assistant shall issue and deliver a certificate of inspection.
D. Any additional gas piping or outlets installed after the above certificate has been issued will require a new permit, testing, and inspection in the same manner as the original installation.
E. Appliances requiring electrical connections of more than 50 volts shall have a positive means of disconnect adjacent to and in line of sight of equipment served, not more than 10 feet from the equipment.
F. All piping materials used for mechanical systems within the city shall be in accordance with the International Mechanical Code or otherwise approved by the building official. [Ord. 4106, 1997; Ord. 3780 § 2, 1992; Ord. 3536 § 3, 1986; Ord. 2310 § 11, 1956.]
3.04.720 Severability.
Should any portion of this chapter be declared invalid, such action shall not affect the validity of the remaining portions hereof. [Ord. 2310 § 17, 1956.]
