3.08.040 Definitions.
For the purposes of this chapter, “swimming pool” shall be deemed to be any pool used for swimming or bathing over 18 inches in depth, or with a surface area exceeding 250 square feet. [Ord. 2426 § 1, 1959.]
3.08.080 Permit required.
It shall be unlawful to construct, operate and maintain a swimming pool within the corporate limits of Ellensburg without a written permit which shall be issued by the city clerk after approval of the city building inspector and upon payment of a fee of $10.00. [Ord. 2426 § 2, 1959.]
3.08.120 Safety.
No permit shall be approved by the city building inspector unless the pool is engineered and designed to withstand the expected forces to which it will be subjected.
All plumbing and water heating equipment shall be of such design and materials as are safe and commonly used and employed for such purposes. All electrical wiring shall be inspected and any wiring or fixture which is found in violation of the State Electrical Code or otherwise unsafe shall be forthwith removed. No swimming pool shall be permitted under overhanging electric power wires. Whenever access to the pool is not restricted by an adequate yard fence or enclosure, some other approved protective device shall be used. [Ord. 2426 § 3, 1959.]
3.08.160 Violation to maintain unsafe pool.
It shall be unlawful for any person, firm or corporation to operate or maintain any swimming pool, regardless of whether a permit for same has been issued, in such a manner or condition as to be unsafe or hazardous to small children or neighboring property. [Ord. 2426 § 4, 1959.]
3.08.200 Noise.
It shall be unlawful to operate or maintain a swimming pool when the noise from use of the pool is loud, unnecessary or unusual and which endangers the comfort, repose, health, peace or safety of others. In the operation of a swimming pool, the use or permitting the use or operation of any radio, receiving set, musical instrument, phonograph or other machine or device for the producing or reproducing of sound in such a manner as to disturb the peace, quiet and comfort of the neighboring inhabitants or at any time with louder volume than is necessary for convenient hearing of the person or persons who are in the swimming pool shall be unlawful. 3.08.240 Inspection.
The city building inspector shall have access to any premises occupied by a swimming pool at any reasonable hour for the purpose of inspecting same. [Ord. 2426 § 6, 1959.]
3.08.280 Separability.
If any section, subsection, sentence, clause, phrase or portion of this chapter is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portion thereof. 3.08.320 Penalty.
Any person, firm or corporation violating this chapter shall upon conviction be fined in a sum not exceeding $300.00 or shall be imprisoned in the city jail for a period not exceeding 90 days, or shall be punished by both such fine and imprisonment. [Ord. 2426 § 8, 1959.]
