4.28.010 Intersection of Sixth and Water to Northern Pacific Railway.
All that certain street, road or highway, beginning at the intersection of Sixth and Water Streets in the city of Ellensburg and leading in a westerly direction along the township line between Townships 17 North, Range 18 East and Township 18 North, Range 18 East, to the point where the same crosses the line of the Northern Pacific Railroad Company’s railroad in said city, be and the same is hereby declared vacated. [Ord. 25 § 1, 1887.]
4.28.020 Alleys in Blocks 8, 39, and 42.
The alleys running north and south through Blocks 8, 39 and 42 of the city of Ellensburg, according to the plat thereof on record in the office of the auditor of Kittitas County, Washington Territory, be and the same is hereby vacated. [Ord. 32 § 1, 1887.]
4.28.030 Portion of Fourth Street.
Fourth Street in the city of Ellensburg be extended, vacated and opened from Water Street westward in a line with said Fourth Street and of the same width to the point where the same intersects the line of the Northern Pacific Railroad Company’s road. [Ord. 40 § 1, 1887.]
4.28.040 Alley in Block 4, First Railroad Addition.
The alley in Block 4 of the First Railroad Addition to Ellensburg, Washington, be and the same is hereby vacated. The city reserves the right to construct and maintain a sewer through said alley whenever it desires so to do. [Ord. 374 §§ 1, 2, 1906.]
4.28.050 “E” Street.
All of that part of “E” Street adjacent to Blocks 38 and 39, and 28 and 29 of the First Railroad Addition to Ellensburg, Washington, bounded on the north by the north line of the southeast quarter of Section 35 in Township 18 North of Range 18 East of the Willamette Meridian, and on the south by a line 200 feet southwesterly of and parallel to the centerline of the railway of the Chicago, Milwaukee and St. Paul Railway Company of Washington as now located and established, be and the same is hereby vacated. 4.28.060 Eleventh Street.
All of that part of Eleventh Street adjacent to Blocks 38 and 39, and Blocks 28 and 29 of the First Railroad Addition to Ellensburg, Washington, included between a line 100 feet northeasterly of and parallel to the centerline of the railway of the Chicago, Milwaukee and St. Paul Railway Company of Washington, as now located and established, and a line 200 feet southwesterly of and parallel to said centerline of said railway, be and the same is hereby vacated. 4.28.070 Alley, Block 29, First Railroad Addition.
All that part of the alley in Block 29 of the First Railroad Addition to Ellensburg, Washington, lying east of a line 200 feet southwesterly of and parallel to the centerline of the railway of the Chicago, Milwaukee and St. Paul Railway Company of Washington, as now located and established, be and the same is hereby vacated. 4.28.080 Walnut Street.
All that part of Walnut Street adjacent to an unplatted strip of land lying east of Block 29 of the First Railroad Addition to Ellensburg, Washington, and Block 71 of Shoudy’s Second Addition to Ellensburg, Washington, bounded on the north by a line 100 feet northeasterly of and parallel to the centerline of the railway of the Chicago, Milwaukee and St. Paul Railway Company of Washington, as now located and established, and bounded on the south by the north line of Tenth Street, be and the same is hereby vacated. 4.28.090 Alley, Block 71, Shoudy’s Second Addition.
All that part of the alley in Block 71 of Shoudy’s Second Addition to Ellensburg, Washington, lying west of a line 100 feet northeasterly of and parallel to the centerline of the railway of the Chicago, Milwaukee and St. Paul Railway Company of Washington, as now located and established, be and the same is hereby vacated. 4.28.100 Tenth Street.
All that portion of Tenth Street adjacent to Block 71 of Shoudy’s Second Addition to Ellensburg, Washington, included between a line 50 feet southwesterly of and parallel to the centerline of the railway of the Chicago, Milwaukee and St. Paul Railway Company of Washington, as now established and located, and the west line of Chestnut Street, and all that part of Tenth Street adjacent to Blocks 72 and 69 of Shoudy’s Second Addition to Ellensburg, Washington, bounded by the east line of the railway of the Chicago, Milwaukee and St. Paul Railway Company of Washington, as now located and established, be and the same are hereby vacated. 4.28.110 Alley, Block 69, Shoudy’s Second Addition.
All that part of the alley in Block 69 of Shoudy’s Second Addition to Ellensburg adjacent to Lot 8 of said block lying east of the line 50 feet southwesterly of and parallel to the centerline of the railway of the Chicago, Milwaukee and St. Paul Railway Company of Washington, as now located and
established, be and the same is hereby vacated. [Ord. 401 § 7, 1907.]
4.28.120 Poplar Street.
All that portion of Poplar Street adjacent to Blocks 68 and 69 in Shoudy’s Second Addition to Ellensburg, Washington, bounded on the north by a line 50 feet northeasterly of and parallel to the centerline of the railway of the Chicago, Milwaukee and St. Paul Railway Company of Washington, as now located and established, and on the south by a line 50 feet southwesterly of and parallel to said centerline of said railway, be and the same is hereby vacated. 4.28.130 Alley, Block 68, Shoudy’s Second Addition.
All that part of the alley in Block 68 of Shoudy’s Second Addition to Ellensburg lying west of a line 50 feet northeasterly of and parallel to the centerline of the railway of the Chicago, Milwaukee and St. Paul Railway Company of Washington, as now located and established, be and the same is hereby vacated. 4.28.140 Rights reserved.
The city reserves the right to construct and maintain sewers and electrical light poles under and across said streets and alleys (ECC 4.28.050 through 4.28.130) so as not to interfere with the operation of the railroad thereon. [Ord. 401 § 9, 1907.]
4.28.150 Eleventh Street.
That portion of Eleventh Street, situated, lying and being east of Water Street, and west of “A” Street and between Blocks 34 and 24 in the First Railroad Addition to the city of Ellensburg, Washington, be and the same is hereby vacated. [Ord. 449 § 1, 1909.]
4.28.160 Portion of Murray’s Addition.
That portion of the plat of Murray’s Addition to Ellensburg, Washington Territory, bounded as follows, to-wit:
Beginning on the line that divides the north half of Section 2 in Township 17 North of Range 18 East of the Willamette Meridian, from the south half of said Section 2 at the point where said line intersects the west boundary line of Water Street as the same is shown upon the Plat of Murray’s Addition to Ellensburg, Washington Territory, on file and of record in the office of the auditor of Kittitas County, Washington, running thence south along the west boundary line of said Water Street to its intersection with the middle line of Manitoba Street, as shown upon said plat, thence west following the middle line of said Manitoba Street to the point of its intersection with the easterly boundary line of the right-of-way of the Northern Pacific Railway Company thence northwesterly following said easterly boundary line of said right-of-way to the point of its intersection with the said line dividing the north half of said Section 2 from the south half of said Section 2, thence east following said line to the point of beginning; and all of the streets and alleys included within said boundaries be and they are hereby vacated. (Blocks 41, 42, 61, 62, 63, 64, 65, 66, 67 and 68 of said Murray’s Addition; subject to the right-of-way for a sewer and the right to construct and maintain the same as provided in that certain contract made by the city of Ellensburg with the said Katarina Murray on February 2, 1909, and recorded February 5, 1909, in the office of the auditor of Kittitas County, Washington, in book 18 of deeds at page 317 of the records of said county.) 4.28.170 Portion of Electric Addition.
The plat of all of Blocks H, I, J and K of Electric Addition to the city of Ellensburg, Washington, according to the plat of said addition on file and of record in the office of the auditor of the county of Kittitas, be and the same is hereby vacated; and all streets and alleys, and all parts of streets and alleys included within the following described boundaries, to-wit:
Beginning at the southwest corner of said Block “K”; thence running north to the north corner of said Block “J”; thence running southeasterly in a straight line to the north corner of said Block “H”; thence running southeasterly to the southeast corner of said Block “H”; thence running west to the point of beginning; be and the same are hereby vacated. 4.28.180 Second Street.
The following described portion of Second Street in the city of Ellensburg, to-wit:
All of that portion of Second Street lying west of the west line projected of the alley intersecting Block 22 in the Depot Addition to the city of Ellensburg, and east of the east boundary line of the right-of-way of the Northern Pacific Railway Company be, and the same is hereby vacated, excepting and reserving to the city of Ellensburg, however, the right to construct, lay and maintain water mains, gas mains, sewers and transmission lines over, under, along and across the portion of said street that had not been vacated. [Ord. 545 § 1, 1911.]
4.28.190 Alleys in Blocks 3 and 4, Homestead Addition.
The following described alleys, to-wit:
The alley in Block 3 and the alley in Block 4 of the Homestead Addition to the city of Ellensburg be and the same are hereby vacated, subject to the right reserved to the city of Ellensburg and its grantees to operate and maintain the sewer and water systems now extending through said alleys, and to lay any water mains required by the city of Ellensburg in the maintenance and operation of a municipal water plant, and to lay any electric light and power conduits, and to lay or permit of being laid any gas mains, telephone wire conduits and telegraph wire conduits. [Ord. 579 § 1, 1912.]
4.28.200 Sprague Street.
The following described portion of Sprague Street in the city of Ellensburg, to-wit:
That portion of Sprague Street lying between Block 3 and Block 4 in the Homestead Addition to the city of Ellensburg; be and the same are hereby vacated, on condition that before the vacation of said portion of said street shall become effective the board of directors of School District No. 3 shall cause to be laid out and graded a roadway 46 feet in width extending from north to south over and across that portion of the eastern half of Block 4 in said Homestead Addition lying immediately west of the present line of Sprague Street, which roadway shall be at all times kept open for public travel and to have a course so that the same will be easily approached from Sprague Street on the north and south, the course of such roadway to have a slight curve to the westward and to extend across portions of Sprague Street herein vacated immediately west of the northwest corner of said Block 3 and of the southwest corner of said Block 3 in said Homestead Addition; and that said roadway shall be paved within Dollarway pavement a width of 30 feet with concrete sidewalks eight feet in width on each side thereof within 10 months from date hereof; and on the further condition that the portion of Sprague Street hereby vacated shall never be obstructed by buildings or trees or any fence over three feet in height so that the view along said street shall be cut off by the same. 4.28.210 Highway intersecting Block 8, Second Railroad Addition.
The following described portion of the highway intersecting Block 8 in the Second Railroad Addition to the city of Ellensburg, Kittitas County, Washington, to-wit:
All of that portion of said highway outside the original boundaries of the alley originally platted through said Block 8 and extending from the west boundary of said Block 8 to the eastern limits of the city of Ellensburg, be and the same is hereby vacated. [Ord. 669 § 1, 1914.]
4.28.220 Alley in Block 9, First Railroad Addition.
The certain portion of the alley in Block 9, First Railroad Addition to the city of Ellensburg, extending from “E” Street east to west side of Lot 11, Block 9, First Railroad Addition, be and the same is herewith vacated. [Ord. 757 § 1, 1919.]
4.28.230 Alley intersecting Block 9, First Railroad Addition.
That portion of the alley intersecting Block 9, in the First Railroad Addition to the city of Ellensburg, from the west line of Lot 6 easterly to the intersection of said alley with Walnut Street and that portion of the alley intersecting Block 1 in the First Railroad Addition of the city of Ellensburg, from the south line of Eighth Street southward, a distance of 107.3 feet, are herewith vacated. Said vacated property shall belong to the abutting property owners, but the city reserves the right to use said property for existing sewer and water pipelines, and for the purpose of going upon the same to repair said sewer and water pipelines. 4.28.240 Tenth Street and certain alley.
All of Tenth Street between the east line of Walnut Street and the west line of Chestnut Street, and that certain alley between the east line of Walnut Street and the west line of Chestnut Street in Block 70, all in Shoudy’s Second Addition to the city of Ellensburg, Washington, be and the same are hereby vacated, reserving, however, from said vacation, the right of the city of Ellensburg to maintain, repair, replace, change or alter any pipe or sewer line or electric or power line of said city now existing upon or in said street or alley, with the right of said city to go thereon and inspect the same to the same and as full extent as the city might do had the same not been vacated and reserving to the holder of any franchise for any public service utility all rights granted under such franchise; and provided, that the owners of the abutting property shall not occupy any portion of either said vacated street or alley in such a manner as to inconvenience, limit or prevent the full exercise of the rights herein reserved to the city of Ellensburg and persons holding franchises from the city of Ellensburg. [Ord. 911 § 1, 1927.]
4.28.250 Nanum and First Streets – Vacation.
The west half of Nanum Street from the south line of Second Street to the east and west quarter line of Section 2, Township 17 North, Range 18 East of the Willamette Meridian in Kittitas County, Washington, and First Street from the east line of Nanum Street to a line 120 feet east of the east line of Nanum Street, all in the city of Ellensburg, Washington, be and the same are hereby vacated, reserving, however, from said vacation, the right of the city of Ellensburg to improve, maintain, repair, replace, change or alter any pipe or sewer line and system, or electric power line of said city now existing upon or in any portion of said streets, with the rights to go thereon and inspect the same to and as full extent as the city might do had the same not been vacated and reserving to the holder of any franchise for any public service utility all rights granted under such franchise; and provided, that the owners of the abutting property shall not occupy any portion of either said vacated streets in such manner as to inconvenience, limit or prevent the full exercise of the rights herein reserved to the city of Ellensburg or persons holding franchises from the city of Ellensburg. 4.28.260 Streets in Blocks 2, 3 and 4, Homestead Addition.
It is hereby ordered that the following described alley, to-wit:
The alley in Block 2 of the Homestead Addition to the city of Ellensburg be and the same is hereby vacated, subject to the rights reserved in the city of Ellensburg and its grantees to operate and maintain the sewer and water systems now extending through said alley, and to lay any water mains required by the city of Ellensburg in the maintenance and operation of a municipal water plant and to lay any electric light and power wire conduits, and to lay or permit of being laid any gas mains, telephone wire conduits and telegraph wire conduits.
And the following described portions of Anderson and Sprague Streets in the city of Ellensburg, to-wit:
That portion of Anderson Street lying between Block 2 and Block 3 and that portion of Sprague Street lying between Block 3 and 4 all in the Homestead Addition to the city of Ellensburg be and the same is hereby vacated;
And the following described portion of Sprague Street in the city of Ellensburg, to-wit:
A tract of land, being all of Sprague Street as now laid out and constructed running north and south through said Block 4 of the Homestead Addition to the city of Ellensburg be and the same is hereby vacated.
It is the intention of the ordinance codified in this section, together with Ordinance No. 606 (see ECC 4.28.190 and 4.28.200) of the city of Ellensburg to grant the vacation of every avenue of ingress and egress running north and south through said Blocks 2, 3 and 4, so that the Consolidated School eastern boundary being the western boundary line of Sampson Street and the western boundary of said tract being the eastern boundary line of Ruby Street. 4.28.270 Portion of Tacoma Addition.
The following portions of streets and alleys in the Tacoma Addition to the city of Ellensburg be and the same are herewith vacated, to-wit:
That portion of the alley in Block 30, from the west side of Cora Avenue, west to the easterly right-of-way line of State Road No. 3.
That portion of Tenth Street from the west side of Cora Avenue west to the easterly right-of-way line of State Road No. 3.
That portion of the alley in Block 31 from the east side of Rainier Avenue (formerly Tacoma Avenue), east to the east lines of Lots 5 and 12 extended, the same being on the east line of state of Washington property.
That portion of Eleventh Street from the east side of Rainier Avenue (formerly Tacoma Avenue), east for a distance of 114.8 feet on the north side, and 170.1 feet on the south side of Eleventh Street; same being the easterly line of state of Washington property.
Not including the Mill Ditch and right-of-way therefor, being a strip 16.5 feet on each side of the center of the Mill Ditch. [Ord. 1005 § 1, 1933.]
4.28.280 Alley in Block 19, First Railroad Addition.
The alley running through Block 19 of the First Railroad Addition to the city of Ellensburg is herewith vacated, but the city reserves the right to continue to run its sewer and water pipeline through said alley with the rights of ingress and to egress from said sewer and pipeline. 4.28.320 Roadway in Block 8, Second Railroad Addition.
All that portion of the roadway running east and west through the center of Block 8 in the Second Railroad Addition to the city of Ellensburg which is north and south respectively of lines drawn parallel and 10 feet distant on both sides of the centerline of said roadway and east of the original city limit line, thus excepting for an alley, a strip 20 feet in width, through the center of said block as platted in the original Sunny-Slope Addition to the city of Ellensburg, is herewith vacated. 4.28.330 Alley in Block 4, First Railroad Addition.
The alley running east and west through the center of Block 4, First Railroad Addition to the city of Ellensburg, in Kittitas County, Washington, is hereby vacated, subject only to the right of the city of Ellensburg to construct, maintain and operate a line or lines for the transmission of electricity by underground conduit therein and to construct, maintain and operate underground water and sewer pipelines. 4.28.340 Poplar Street.
Poplar Street from the north line of Sixth Street to the south line of Seventh Street and that portion of the alley in Block 60, Shoudy’s Second Addition to the city of Ellensburg, lying east of the east line of Lots 2 and 15 of said block be and the same are hereby vacated. [Ord. 1187 § 2, 1945.]
4.28.350 Alley in Block 11, Hick’s Addition.
All that portion of the alley in Block 11, Hick’s Addition to Ellensburg lying east of a line extending north across said alley and 20 feet east of the west line extended of Lot 10 of said block, be and the same is hereby vacated. [Ord. 1198 § 2, 1946.]
4.28.360 Alley in Block 65, Shoudy’s Second Addition.
All of the alley in Block 65, Shoudy’s Second Addition to Ellensburg be and the same is hereby vacated, subject to conditions expressed hereinafter, to-wit:
This vacation is made pursuant to agreement with the Central Washington College of Education that the city of Ellensburg will at all times hereafter be permitted to maintain and reconstruct from time to time the existing sewer line through said block on the abutting property as conditions and growth of the city of Ellensburg may require. 4.28.370 Alley in Block 8, Homestead Addition and Washington Avenue.
All of the alley in Block 8 in the Homestead Addition and that portion of Washington Avenue between the east line of Sampson Street and the west line of Walnut Street be and the same is hereby vacated subject to the conditions expressed hereinafter, to-wit:
This vacation shall not take effect until the board of directors of School District 401 have caused to be filed with the city clerk a written agreement in which the school district agrees to relocate the existing power, water or sewer lines in the alley or street vacated on adjoining lands of the district and which grants to the city of Ellensburg the right to replace and maintain such lines as relocated, and further agrees to provide at all times for public use on adjoining lands a proper means of ingress and egress to and from the north end of the alley in Block 9 of the Homestead Addition to Ellensburg. 4.28.380 “C” Street.
That portion of “C” Street extending north of the north line of Eleventh Street to the north line of the First Railroad Addition to the city of Ellensburg be and the same is hereby vacated subject to the following reservations:
The city of Ellensburg does hereby retain an easement and the right to extend and grant easements in respect to said vacated portion of “C” Street for the construction, repair and maintenance of public utilities and services from time to time as need for same may arise. 4.28.390 Ninth and Cora Avenues.
The streets described as follows:
All that portion of Ninth Avenue lying between Blocks 29 and 30, Tacoma Addition to the city of Ellensburg, county of Kittitas, state of Washington, south and west of the State Highway;
All that portion of Cora Avenue lying between the west boundary line of Lot 1, Block 28, Tacoma Addition to the city of Ellensburg, county of Kittitas, state of Washington, and the east boundary line of Lot 8, Block 29, said Tacoma Addition to the city of Ellensburg, and extending from the north line of the alley running east and west through said Blocks 28 and 29, north to the southwesterly boundary line of the State Highway;
Are hereby vacated.

4.28.420 Alley between Fifth and Fourth Avenues.
That certain portion of the alley which extends east and west between West Fifth Avenue and West Fourth Avenue and bounded on the south by the north line of Lot 19, and on the north by the south line of Lots 1, 2, 3 and a portion of Lot 4, Cascade Addition to Ellensburg, be and the same is hereby vacated. 4.28.430 “E” Street.
“E” Street from a point 160 feet north of the north line of Ninth Avenue extended to the south line of 10th Avenue and Ninth Avenue between the east line of Walnut Street and the west line of Chestnut Street be and the same are hereby vacated. The city of Ellensburg hereby retains an easement or the right to extend or grant easements in respect to the areas so vacated for the construction, repair and maintenance of public utilities and services. 4.28.440 Alley in Block 75, Shoudy’s Second Addition.
The alley in Block 75, Shoudy’s Second Addition to the city of Ellensburg, be and the same is hereby vacated.

4.28.470 Alley through Blocks 33, 32, Santa Anna Addition – Seattle Avenue – Poplar Street.
Subject to reservations set forth below in this section, the following described streets and alleys of the city of Ellensburg, to-wit:
The alley extending through Blocks 33 and 32, Santa Anna Addition;
The north 20 feet of Seattle Avenue between Chestnut and Maple Streets; and
Poplar Street between Manitoba and Seattle Avenues, are hereby vacated.
The city of Ellensburg does hereby retain an easement and the right to use, operate, maintain, and replace the existing sewer line as presently located in that portion of the said north 20 feet of Seattle Avenue abutting Lot 10, Block 33, Santa Anna Addition, which pipeline extends across Seattle Avenue and joins the existing sewer serving Block “A” of Mountain View Addition. 4.28.480 First Avenue.
The street described as follows:
All of that portion of First Avenue lying between Blocks 24 and 27, Depot Addition to the city of Ellensburg, county of Kittitas, state of Washington, as per plat thereof recorded in book 1 of plats, page 59, records of said county, and extending from the west boundary line of the alley through said blocks west to the east boundary line of Nanum Street is hereby vacated, subject only to the right of the city of Ellensburg to retain an easement and the right to exercise and grant easements in respect to the vacated land above described for the construction, repair, and maintenance of public utilities and services. 4.28.510 Alley in Block 56, Shoudy’s Second Addition.
Subject to reservations set forth in this section:
That portion of the alley in Block 56, Shoudy’s Second Addition to Ellensburg, lying between Lots 3, 4 and 5 and Lots 12, 13 and 14 thereof is hereby vacated.
The city of Ellensburg abandons and grants to Kittitas County as owner of the property served thereby all sewer facilities situated in the vacated portion of said alley; provided, that the city of Ellensburg reserves right of access to the sewer manhole situated therein for the purpose of maintaining the sewer line in said alley west of the portion vacated hereunder. 4.28.520 West Ninth Avenue.
That portion of west Ninth Avenue west of the west line of Delphine Street and east of Cascade Way be and the same is hereby vacated.

4.28.530 Skyline Drive, Vista Road and portion of Lot 9, Block 4, Vue Crest Addition.
The following described streets and areas dedicated for public use as roadways be and the same are hereby vacated, to-wit:
Skyline Drive as shown on the recorded plat of Vue Crest Addition to the city of Ellensburg, together with the west 10 feet of Lots 1 through 5, Block 2, Vue Crest Addition, as conveyed to Kittitas County by deed recorded in book 90 of deeds, page 402; except that portion of said Skyline Drive lying west of the east line of Lot 5, Block 1, in said addition projected north to the southeast corner of Lot 9, Block 4, in said addition.
That portion of Vista Road which is bounded on the north by the north line extended of Lot 11, Block 3, Vue Crest Addition, and on the south by the south line extended of Lot 9 of said block, including all of said portion of Vista Road situated in the plat of Vue Crest Addition and in the plat of State Addition No. 1 to Ellensburg.
The north 40.35 feet of Lot 9, Block 4, Vue Crest Addition conveyed to the county of Kittitas by deed dated October 16, 1952, and recorded in book 90 of deeds, page 525. [Ord. 2407 § 2, 1959.]
4.28.540 Second Avenue.
Second Avenue west of the west line of Lincoln Street and east of the west line extended of Lot 1, Block 15, Electric Addition be and the same is hereby vacated.

4.28.560 Poplar Street.
That portion of Poplar Street lying north of Eleventh Avenue and south of the Ellensburg Water Company canal is hereby vacated.

4.28.580 Sixth Avenue.
All of that portion of Sixth Avenue extending east of a point which is 121 feet east of the east line of Poplar Street is hereby vacated.
There is hereby reserved to the city an easement and right to exercise and grant easements in respect to said vacated land for the construction, repair and maintenance of public utilities and services. [Ord. 2483 §§ 1, 2, 1961.]
4.28.620 Ninth Avenue.
That portion of Ninth Avenue from “E” Street east to Walnut Street and that portion of “E” Street from the north line of Eighth Avenue to a point 160 feet north of the north line of Ninth Avenue and from Tenth Avenue to the Chicago, Milwaukee, St. Paul and Pacific Railway Company right-of-way and the north 23 feet of Tenth Avenue from the west line of Lot 10, Block 28, First Railroad Addition to the west line of Walnut Street is hereby vacated, subject only to the reservation set forth in this section.

4.28.720 Unnamed street in State Addition No. 1.

The following street is hereby vacated:

4.28.1060 East Twelfth Avenue and North “E” Street.
The following streets are hereby vacated:
That portion of East 12th Avenue which lies west of North “E” Street, and east of a point 100 feet east of North “D” Street; and also that portion of North “E” Street which lies north of the right-of-way of the Chicago, Milwaukee, St. Paul and Pacific Railroad Company, and south of that canal, known as the “Town Ditch,” all in the city of Ellensburg.
The city of Ellensburg retains an easement for purposes of construction, maintenance and repair of a sewer line in the following described portion of the above-described vacated street:
A 10-foot-wide easement for that sewer line presently existing and lying in Twelfth Avenue west of a point 160 feet west of the west margin of “E” Street. [Ord. 2654 §§ 1, 2, 1966.]
4.28.1070 Part of Eleventh Avenue.
The following portions of Eleventh Avenue are hereby vacated:
From the eastern edge of the Walnut Street right-of-way to the west side of that part of the Chestnut Street right-of-way lying south of the north edge of the Eleventh Avenue right-of-way; and from the east side of that part of Chestnut Street lying north of Eleventh Avenue to the west edge of the Poplar Street right-of-way. 4.28.1080 Part of Delphine Street.
The following portion of Delphine Street is hereby vacated:

4.28.1090 Part of Delphine Street.
The following portions of Delphine Street are hereby vacated:
The east 10 feet of the Delphine Street right-of-way lying adjacent to the west side of Lot 16, Block 18, Tacoma Addition to the city of Ellensburg.
The west 10 feet of the Delphine Street right-of-way lying adjacent to the east side of Lot 9, Block 25, Tacoma Addition to the city of Ellensburg. [Ord. 2705 § 1, 1967.]

The following alley, or a portion thereof, is hereby vacated:

4.28.1120 Part of 11th Avenue.
The following described portion of 11th Avenue in the city of Ellensburg, Washington is hereby vacated:
The north 30 feet of the south 40 feet of 11th Avenue lying adjacent to Lot 5 and the east 28 feet of Lot 4, Block 31, Tacoma Addition to the city of Ellensburg;
As also described in that certain dedication deed dated July 19, 1966, and recorded in volume 123 of deeds, page 37, Kittitas County Auditor’s File No. 332134.

4.28.1130 Alley in Block “E,” First Railroad Addition.
The following described strip of land presently dedicated as an alley, or portion of a former alley right-of-way, in the city of Ellensburg, Washington, is hereby vacated:
That certain strip of land extending southerly from 8th Avenue and lying between Main Street and Pearl Street, in Block “E,” First Railroad Addition to the city of Ellensburg, heretofore dedicated and designated as a public alley right-of-way.
The city retains an easement and the right to grant easements in respect to said vacated area for purposes of construction, repair and maintenance of public utilities and service lines and facilities. [Ord. 2762 §§ 1, 2, 1969.]
4.28.1140 East Eleventh, East Fifteenth Avenues, alleys in Michel’s First Addition and First Railroad Addition.
A. The following portions of the following described streets and alleys are hereby vacated:
East Eleventh Avenue from the east line of North “D” Street to a line 200 feet southwesterly and parallel to the centerline of the main track of the Chicago, Milwaukee, St. Paul and Pacific Railroad;
East Fifteenth Avenue between the east line of North “D” Street and the west line of North Walnut Street;
The alley in Block 11 of Michel’s First Addition;
The east 200 feet of alley in Block 8 of Michel’s First Addition;
The west 300 feet and north half of the east 100 feet of alley in Block 28 of First Railroad Addition.
B. Except as hereinafter provided, all interests of the city in and to those portions of those streets and alleys described in subsection (A) of this section are transferred and conveyed to the urban renewal department for improvements and/or disposition in accordance with the urban renewal plan for the north Campus Urban Renewal Project, Washington No. R-16, adopted December 19, 1966.
C. The city retains an easement and the right to grant easements in respect to the vacated areas temporarily, for the purposes of construction, repair and maintenance of public utilities and services until conveyance of the fee title of each parcel of the vacated premises to Central Washington State College in accordance with that urban renewal plan described in subsection (B) of this section. Upon conveyance by the city of any of the parcels of property herein described, the temporary easement right retained shall terminate and the conveyance shall specifically provide for the permanent easement rights, if any, which shall be retained and/or granted. 4.28.1150 Alley in Block 11, Hick’s Addition.

4.28.1160 Schnebly Fruit Lands Addition tracts.
A. The following described portion of the plat of Schnebly Fruit Lands Addition is hereby vacated:
Tracts 19, 20, 21, 22, 23, and that portion of Tract 24 lying north of the north right-of-way boundary of the State Highway, Schnebly Fruit Lands Addition, in Kittitas County, Washington, as per plat thereof recorded in book 2 of plats, page 37, records of Kittitas County; except that portion of Tract 24, legally described as follows:
Beginning at a point on the east boundary line of Section 2, Township 17 North, Range 18 East, Willamette Meridian, which is 118 feet north of the southeast corner thereof, and being also six feet north of the southeast corner of Tract 24, Schnebly Fruit Lands, thence running north 89 degrees 40' west on the north right-of-way line of the Kittitas Highway, 40 feet to the true point of beginning; thence running north 89 degrees 40' west on this north line, 170 feet; thence north zero degrees 51' east, parallel with the section line, 140 feet; thence south 89 degrees 40' east 170 feet, and thence south zero degrees 51' west 140 feet to the true point of beginning.
B. The vacation hereby authorized and ordered is not intended, nor shall it be deemed, to vacate any public rights-of-way or public easements for the construction, repair, maintenance, or replacement of any public utilities or services, if in fact any such easements exist. 4.28.1170 Alder Street, alley, Block 59, Santa Anna Addition.
The following portions of the following described alleys and streets are hereby vacated:
That portion of that alley situated in Block 59, Santa Anna Addition;
That portion of the west one-half of Alder Street lying easterly and adjacent to Lots 8 and 9, Block 59, of Santa Anna Addition. [Ord. 2825 § 1, 1970.]
4.28.1180 South Anderson Street, Schnebly Fruit Lands Addition.
All of South Anderson Street lying between the south boundary line of Cherry Lane and East Cherry Lane, and the north boundary line of Mountain View Avenue as now constituted, the property being contained within, and as platted in Schnebly Fruit Lands Addition is hereby vacated.
The city reserves an easement and the right to grant easements over and across the right-of-way area for purposes of construction, maintenance and repair of public utility service facilities. [Ord. 2833 §§ 1, 2, 1970.]
4.28.1190 Saint Louis and North “E” Street, Sixteenth Avenue, alley in Block 9, Martin’s Replat.
A. The following portions of the following described streets and alley are hereby vacated:
Saint Louis Street from the east line of North “E” Street to a line 200 feet west of the west line of North “E” Street;
East 16th Avenue from the west line of North Walnut Street to the west line of North “E” Street;
North “E” Street from the north line of East 16th Avenue to the south line of Saint Louis Street;
The alley in Block 9 of Martin’s Replat of part of Blocks 4 and 9 of Hick’s Addition.
B. Except as hereinafter provided, all interests of the city in and to those portions of those streets and alley described in subsection (A) of this section are transferred and conveyed to Central Washington State College in accordance with the urban renewal plan for the North Campus Urban Renewal Project, adopted December 19, 1966.
C. The city retains an easement for purposes of repair and maintenance of public utilities and services along strips of land 20 feet in width and lying 10 feet on either side of the following described centerlines:
A line parallel and 40 feet south of the north line of East 16th Avenue between the west line of North “E” Street and the west line of North Walnut Street;
A line parallel and 35 feet west of the east line of North “E” Street between the south line of East 16th Avenue and the north line of Saint Louis Street. [Ord. 2836 §§ 1, 2, 3, 1970.]
4.28.1200 Alley in Block 10, Knox and McIntyre’s Addition.
The following described strip of land, presently dedicated as an alley right-of-way in the city of Ellensburg, Washington, is vacated:

4.28.1210 Part of “D” Street.
The following described strip of land heretofore dedicated as a portion of “A” Street, and now known as “D” Street in the city of Ellensburg, Washington, is vacated:
That portion of “A” Street, now “D” Street, lying south of the north line of that alley in Block 10, projected east and west through Blocks 10 and 11, and lying north of the north line of Illinois Street, now also known as 18th Street, all in the Knox and McIntyre’s Addition to the city of Ellensburg. The following portions of the following described street are hereby vacated:
That portion of the northeast quarter of Section 35, Township 18 North, Range 18 East, Willamette Meridian, described as follows: That portion of Illinois Street as platted in Knox and McIntyre’s Addition to Ellensburg lying north of a line drawn parallel with and 30 feet north of the following described line:
Commencing at the northwest corner of the northeast quarter of Section 35, Township 18 North, Range 18 East, Willamette Meridian; thence south 89 degrees 47'51" east along the north line of said subdivision 1314.18 feet; thence south zero degrees 01'34" west 1,287.00 feet to the true point of beginning which is the intersection of the centerline of 18th Avenue as platted in Green Parks No. 1, recorded in plats of Kittitas County, Washington, and the east boundary line of said plat; thence easterly in a straight line to the southeast corner of the northeast quarter of the northeast quarter of said Section 35 and the end of the described line. That certain portion of the Willow Street right-of-way lying easterly of Block 3, Pattenaude’s Subdivision of Blocks A and B, Second Railroad Addition to the lots of Ellensburg, Washington, easterly of Lot 12, Block 2 of said subdivision, and between Lot 16, Block 69 and Lot 9, Block 70, Santa Anna Addition to the city of Ellensburg, Washington, all in Section 1, Township 17 North, Range 18 East of the Willamette Meridian, Kittitas County, Washington.

All that portion of said street lying north of the right-of-way line of the Burlington Northern Railway and south of a line which is 66 feet south of and parallel to the following described centerline: the centerline is described as the extended radius of the curve of Canyon Road which passes through the intersection, as established by cased monument in 1971 of Canyon Road and Mountain View Avenue.

4.28.1260 Part of Ninth Avenue.
The following street or portion thereof in the city of Ellensburg is vacated:
The north 20 feet of Ninth Avenue, lying adjacent to Lots 9 through 15 inclusive, Block 68, Shoudy’s Second Addition to Ellensburg, in the county of Kittitas, state of Washington, as per plat thereof recorded in book 1 of plats, page 11, records of Kittitas County.
The city of Ellensburg retains an easement and the right to grant easements in respect to the vacated area for purposes of construction, repair and maintenance of public utilities and services.
The street right-of-way vacation provided for in this section is expressly conditioned upon satisfaction of and compliance with the following requirements:
A. There shall be constructed and installed appropriate concrete curbs and gutters along a line parallel with and three and one-half feet south of the south line of the vacated strip, within the remaining street right-of-way, so as to border and protect that pedestrian walkway hereinafter described;
B. There shall be established, constructed and maintained along the entire length of the south line of the vacated strip, and lying along the north side of the curb installation, an asphalt-paved pedestrian walkway at least four feet in width which cannot be physically obstructed or encroached upon by the parking or overhang of vehicles thereon;
C. The walkway and the curbs and gutters required by this section shall be constructed and installed at no expense to the city;
D. The ordinance codified in this section shall be subject to repeal in the event of noncompliance with the requirement of installation of the curbs, gutters and walkways. [Ord. 3016 §§ 1, 2, 3, 1974.]

A. A portion of Eleventh Avenue and an alley, described as follows, is vacated:

That portion of Eleventh Avenue adjacent to and abutting upon Block 31 and Block 32 of the Tacoma Addition; except the south 30 feet of the north 40 feet of Eleventh Avenue lying adjacent to Lots 9 through 13 inclusive and the east 34 feet of Lot 14, Block 32 of said addition.

That segment of the right-of-way of Eleventh Avenue in the city of Ellensburg, county of Kittitas, state of Washington, described as follows: the west 280.24 feet of said right-of-way lying west of a point on the centerline of said right-of-way; said point lying south 88 degrees 14'00" west, 240.25 feet from the centerline of Maple Street extended, as per plat of College Addition filed in volume 7 of plats, page 1, records of Kittitas County.

A. The following street or portion thereof in the city of Ellensburg is hereby vacated:
That segment of the right-of-way of Cascade Road in the city of Ellensburg, county of Kittitas, state of Washington, described as follows: Beginning at a point which is 239.3 feet west of the east section line of Section 33, Township 18 North, Range 18 East and traveling west to the northeast right-of-way line of the state highway known as I-90.

That portion of existing Sprague Street near Eighth Avenue described as follows: Beginning at the northwest corner of Lot 7, Block 11, College Addition to the city of Ellensburg; thence south 88 degrees 07'22" west, and parallel to the south right-of-way line of Eighth Avenue, 80 feet more or less to the west right-of-way line of Sprague Street and the point of beginning; thence north 88 degrees 07'22" east, 55.0 feet; thence south 32 degrees 37'45" west, 97.08 feet more or less to the west right-of-way line of Sprague Street; thence north along said west right-of-way line 80.0 feet more or less to the point of beginning. 4.28.1530 Sprague Street between Fourth and Fifth Avenues.
A. The following right-of-way of Sprague Street in the city of Ellensburg is hereby vacated:
That portion of Sprague Street located between Fourth and Fifth Avenues, adjacent to Blocks 39 and 40, Shoudy’s First Addition to the city of Ellensburg.
B. This vacation shall not become effective until the following conditions have been fulfilled:
1. The petitioners shall pay to the city of Ellensburg the sum of $67,500 as provided in RCW 35.79.030;
2. The petitioners shall satisfactorily relocate any utilities that are in conflict with the developed site; and
3. The petitioners have obtained a building permit for the construction of a 42,000 to 55,000 square foot Safeway store on the site consisting of Block 40 and the east half of Block 39, Shoudy’s First Addition to the city of Ellensburg; said store to be constructed and occupied prior to December 31, 2000.
C. Failure to satisfy the conditions set forth in subsection (B) of this section prior to December 31, 2000, shall automatically rescind this vacation. [Ord. 4134, 1998.]
4.28.1540 Part of “B” Street, south of Fourteenth Avenue.
A. The following right-of-way of “B” Street in the city of Ellensburg is hereby vacated:
That portion of the northwest quarter of the southeast quarter of Section 35, Township 18 North, Range 18 East, Willamette Meridian, in the county of Kittitas, state of Washington, described as follows:
Beginning at the monumented intersection of 14th Avenue and “B” Street as shown on the College Addition replat as recorded in book 7 of plats at page 1, under Auditor’s File No. 404885, records of Kittitas County, Washington; thence south 01°29'20" east, along the monumented centerline of “B” Street as shown on said replat, 65.03 feet to the south right-of-way boundary of 14th Avenue as shown on that certain drawing on file with the city of Ellensburg engineering department, titled “L-2912, College Access R/W Map, DWG. No. 67-012-1” and dated January, 1966; thence south 89°43'47" east, along said right-of-way boundary, 20.02 feet to the true point of beginning; thence south 89°43'47" east, along said right-of-way boundary, 16.17 feet; thence north 00°16'13" east, along said right-of-way boundary, 5.00 feet; thence north 45°16'13" east, along said right-of-way boundary, 35.36 feet; thence north 89°43'47" west, 11.17 feet to the point of curvature for a 30.00 foot radius curve to the left; thence along said curve, through a central angle of 90°00'00", an arc distance of 47.12 feet, more or less, to the true point of beginning. Containing 604 square feet, more or less.
B. This vacation shall not become effective until the following condition has been fulfilled: the petitioners shall pay to the city of Ellensburg the sum of $505.10 as provided in RCW 35.79.030. [Ord. 4139, 1998.]
4.28.1550 Part of Murray Avenue, west of Pine Street.
A. The following right-of-way of Murray Street in the city of Ellensburg is hereby vacated:
That portion of the southwest quarter of the southeast quarter of Section 2, Township 17 North, Range 18 East, Willamette Meridian, in the county of Kittitas, state of Washington, described as follows:
Murray Avenue from the west right-of-way line of Pine Street west to the east right-of-way line of the alley west of Pine Street. Containing 9,600 square feet, more or less.
B. This vacation shall not become effective until the following condition has been fulfulled: The petitioners shall pay to the city of Ellensburg the sum of $15,600 as provided in RCW 35.79.030. [Ord. 4156, 1998.]
4.28.1560 Portion of Kittitas Street, Capitol Avenue and First Avenue.
A. The following portion of Kittitas Street, Capitol Avenue and First Avenue in the city of Ellensburg is hereby vacated:
That portion of Kittitas Street, described as follows: Beginning at the intersection of the south line of First Avenue and the west line of Kittitas Street, thence traveling south along said west line to the intersection of Kittitas Street and the east line of the Burlington Northern Railway right-of-way; thence southeasterly along said railway right-of-way to the north right-of-way line of Manitoba Avenue; thence east along said north line to the east right-of-way line of Kittitas Street; thence north along said east right-of-way line of Kittitas Street to the south right-of-way line of First Avenue; thence west along said south line to the point of beginning.
That portion of the south half of First Avenue lying between the west line of Kittitas Street west to the west line of the alley in Block 24, Depot Addition to the city of Ellensburg.
That portion of Capitol Avenue lying between the west line of Water Street and the east line of Kittitas Street.
B. This vacation shall not become effective until the following conditions have been fulfilled:
1. Parcels receiving property as a result of the vacation shall pay to the city of Ellensburg the sum of $1.08 per square foot for the vacated property as provided in RCW 35.79.030.
2. Vacation of the property is subject to the petitioner successfully completing the purchase of property currently under contract to it which directly abuts any of the rights-of-way sought to be vacated, and further successfully obtaining the necessary permits for the Fred Meyer development prior to December 31, 2000. Extension of the date by which development permits must be obtained may be extended by mutual agreement between the petitioner and the city.
C. Failure to satisfy the conditions set forth in subsection (B) of this section prior to December 31, 2000, shall automatically rescind this vacation.
D. The roadways identified in the above vacation are subject to the right of the city of Ellensburg to retain easements for utility purposes for the construction, repair and maintenance of utility systems. [Ord. 4195, 1999; Ord. 4187, 1999.]
4.28.1570 Portion of Walnut Circle.
A. The following portion of Walnut Circle in the city of Ellensburg is hereby vacated:
Commencing at the northeast corner of said Section 35, thence north 89°34'30" west 280.00 feet; thence south 0°13'00" west 677.00 feet; thence north 89°51'00" west 30.00 feet to the point of beginning; thence continuing north 89°51'00" west 60.00 feet; thence north 0°13'00" east 50.09 feet; thence south 89°47'00" east 60.00 feet; thence south 0°13'00" west 50.02 feet to the point of beginning, containing 3,003 square feet, more or less.
B. This vacation shall not become effective until the abutting property owner shall convey to the city of Ellensburg an easement for utility purposes across the east 10 feet of the following described parcel:
Beginning at a point 27 feet south and 30 feet west of the northeast corner of Section 35, Township 18 North, Range 18 East, Willamette Meridian, thence south 0°13' west 217.5 feet to the true point of beginning; thence continuing south 0°13' west 432.5 feet; thence north 89°51' west 250 feet; thence north 0°13' east 432.5 feet; thence south 89°51' east 250 feet to the true point of beginning.
C. This vacation shall not become effective until the abutting property owner shall cause to be paid to the city of Ellensburg the sum of $1,501.50, as provided in RCW 35.79.030.
D. Failure to convey said easement and to pay the prescribed fees to the city of Ellensburg by August 31, 1999, shall automatically rescind this vacation. [Ord. 4188, 1999.]
4.28.1580 Alleys – Blocks 26 and 65, Depot Addition – Block 66, Murray’s Addition.
A. The following alleys in the city of Ellensburg are hereby vacated, subject to the right of the city of Ellensburg to retain easements for utility purposes for the construction, repair, and maintenance of utility systems:
All of the alley located in Block 26, Depot Addition to the city of Ellensburg, together with all of the alley located in Block 66 of Murray’s Addition; and
All of the alley located in Block 65, Depot Addition to the city of Ellensburg.
B. This vacation shall not become effective until the following conditions have been fulfilled:
1. Parcels receiving property as a result of the vacation shall pay to the city of Ellensburg the sum of $1.08 per square foot for the vacated property as provided in RCW 35.79.030.
2. Vacation of the property is subject to the petitioner successfully completing the purchase of property currently under contract to it which directly abuts any of the rights-of-way sought to be vacated, and further successfully obtaining the necessary permits for the Fred Meyer development prior to December 31, 2000.
