5.14.040 Depositing refuse prohibited.

No person shall make any deposit or accumulation of manure, offal, garbage, kitchen refuse, slops or other offensive or nauseous substances, or cinders, ashes or rubbish to be made, deposited upon or within the limits of any street, alley, public place, or highway of the city of Ellensburg or along the line of or upon the right-of-way of any railway within the limits of the city of Ellensburg or upon or along the road leading to the city dumping grounds or upon any adjacent private property not owned or occupied by the persons making such deposit. 5.14.120 Violation of ECC 5.14.040 – Penalty.

Every deposit or accumulation of manure, offal, garbage, kitchen refuse, slops or other offensive or nauseous substances or cinders or ashes made or permitted in violation of ECC 5.14.040, whether made or permitted upon private grounds or upon the streets, alleys or public places of the city, is declared a nuisance and upon conviction thereof will be fined the sum of not less than $1.00 nor more than $25.00 and the costs of prosecution. 5.14.160 Foul or deleterious matter – Protection of sewers.

It is unlawful for any person to cast or deposit upon the surface of any lot within the city of Ellensburg, situated in a block through which a public sewer is or shall be constructed, any foul or deleterious matter.

Any person violating the provisions of this section shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in any sum not less than $5.00 nor more than $50.00. [Ord. 277 § 1, 1901.]

5.14.200 Rubbish and refuse to be removed.

It is unlawful for any person to permit to remain upon any portion of private property or upon any street or alley abutting on property of which he is the owner or of which he has charge, or upon any inadequately screened vacant lot or block of which he is the owner or of which he has charge, any rubbish or refuse material of any description, after having been given by the chief of police, the fire chief, or their designee, three days' notice in writing to remove the same. This prohibition includes maintaining on such property refrigerators, other household appliances or parts thereof which are abandoned, discarded, or no longer in use, shafts or unauthorized excavations, apparently inoperative equipment, structurally unsound fencing or other fixtures, vegetation which is creating a fire hazard, or other debris stored or discarded in a fashion likely to attract rodents or create health, fire, or safety hazards.

If any person so notified shall, after the space of three days after such notice is served upon him, fail or neglect to remove such rubbish or refuse material upon conviction thereof, he shall be deemed guilty of a misdemeanor. [Ord. 3709 § 1, 1990; Ord. 3689 § 1, 1990; Ord. 259 §§ 1, 2, 1899.]

5.14.240 Depositing rubbish on streets.

No person, firm, company or corporation, nor the agent, representative, or employee of any person, firm, company or corporation, shall place, throw, or deposit, in or on any street, sidewalk, alley or public grounds in the city of Ellensburg, any broken glass, bottles, crockery, nails, stones, bricks, mortar, earth, gravel, wood, shavings, offal, rubbish, paper or trash whatever, whereby sidewalk, street, alley or public ground is injured, obstructed or made unclean.

Any person, firm, company or corporation engaged whether as owner or employee in drawing or transporting any of the aforesaid articles or substances through, over or upon any of the streets, shall carry the same in tight cars, wagons, carts, drays, or boxes so constructed that such articles or substances cannot fall out or be scattered upon any street, sidewalk, alley or public ground; provided, however, that in case of any such article or substance falling or being scattered upon any street or sidewalk or alley or public ground, the same shall be forthwith removed by the person at such time in charge of the vehicle or conveyance from which such article or substance fell or was scattered. 5.14.250 Depositing snow and ice from parking lots on streets.

No person, firm, company or corporation, nor the agent, representative or employee of any person, firm, company or corporation, shall plow or otherwise clear a parking lot of snow and ice and thereafter place, throw or deposit that snow or ice on any street, alley or sidewalk.

A violation of this section shall be a civil infraction, as contemplated by Chapter 7.80 RCW, and deemed to be a Class 1 civil infraction under RCW 7.80.120(1)(a). The maximum penalty and the default amount for a Class 1 civil infraction is $250.00, plus statutory assessments. A violater may also be required to pay restitution, as is contemplated by RCW 7.80.120(4). [Ord. 3959 § 1, 1994.]

5.14.280 Dirt falling from vehicles.

Any person, firm, company or corporation carrying, hauling or transporting, or causing to be carried, hauled or transported, any of the articles mentioned in ECC 5.14.240, over or upon any of the paved streets, avenues or alleys of the city of Ellensburg, shall, before going upon such paved streets, avenues or alleys, remove or cause to be removed from the wheels, gears, body or other portion of the car, wagon, cart, dray or other vehicle in which articles or article is being carried, or transported, all loose gravel, sand, dirt, shavings, sawdust, trash, or other substance, so that the same will not be scattered, thrown or left upon said pavement. 5.14.320 Storekeeper depositing rubbish in street.

No merchant, storekeeper or other person shall sweep, place or deposit, or cause or permit to be swept, placed or deposited, upon any street, sidewalk, alley, or public ground in the city of Ellensburg any shavings, papers, refuse, or dirt from premises owned or occupied by him or under his control; provided, nothing in this section shall be construed to prevent the sweeping of snow or dirt resulting from travel upon the sidewalks into the street. 5.14.360 Building fire – Placing building material on streets – Permit required.

No person or persons shall build any fire, slack lime, mix mortar, or place gravel or sand, building material or other substance upon any of the paved streets, avenues, or alleys in the city of Ellensburg without first obtaining from the street commissioner of the city of Ellensburg a permit therefor; and no person or persons shall be permitted or allowed to build any fire, slack lime, mix mortar, or place or deposit any said gravel, building material or other substance upon any of the paved streets, avenues or alleys in the city of Ellensburg in such manner as to permit the same to come in contact with the pavement of such street, avenue or alley; and when the same is permitted by the street commissioner, such lime, mortar, sand, gravel or other building material shall be placed in a tight box sufficient to prevent any of such substances from being scattered upon or coming in contact with such paved street, avenue or alley. 5.14.400 Violation of ECC 5.14.240 through 5.14.360 – Penalty.

Any person violating ECC 5.14.240 through 5.14.360 shall, upon conviction thereof, be fined in any sum not more than $100.00 nor less than $5.00. [Ord. 532 § 5, 1910.]
