5.38.040 Speed limit – Riding into houses.
A. It shall be unlawful for any person or persons to ride or drive any horse, mare or mule or saddle or work animal of any description in or upon any of the streets, alleys, public highways or any lot or lots within the city of Ellensburg faster than an ordinary traveling gait, or ride or drive any of said animals across or into any sidewalk, or into any saloon or drinking house, store house or dwelling house within said city limits.
B. Penalty. Any person or persons violating any of the provisions of this section shall be deemed guilty of a misdemeanor and upon conviction therefor shall be punished by a fine of not less than $5.00 nor more than $300.00 together with costs of prosecution, and stand committed until such fine and costs are paid, and any party so convicted shall be worked upon the streets or other public works of the city of Ellensburg under the direction of the street commissioner of the said city and shall be allowed for each day's work so performed the sum of $3.00 to be applied on the judgment of said fine and costs, and shall, unless said fine and costs are otherwise paid, so continue to work as aforesaid until such fine and costs are fully paid. 5.38.080 Driving animals or vehicles on park strips.
A. It is hereby declared unlawful for any person or persons to lead or drive any horse, cow or other animal or any vehicle of any kind over, across or upon any park strip or along the sidewalk of streets of the city of Ellensburg.
B. Penalty. Any person who shall violate the provisions of this section and be found guilty thereof shall be fined in the sum of not less than $10.00 nor more than $25.00, to which shall be added the costs of prosecution. [Ord. 433, 1908.]
5.38.120 Unlawful to drive animals in city – Exceptions.
A. It shall be unlawful for any person or persons to drive any herd or drove of more than five head of horses, mules, or meat cattle, or more than 10 head of sheep or swine, through, over or across the streets, alleys and public places of the city of Ellensburg, except that upon giving notice at least three hours in advance to the chief of police or any policeman of the city of Ellensburg of intention so to do, stating the exact time and place where the same are to be driven, it shall be lawful to drive bands of horses, mules, meat cattle, sheep and swine, on the following named streets in the city of Ellensburg: Columbia Street and Columbia Street produced, from the north of the city limits south to Eighth Street, west on Eighth Street to Nanum Street, south on Nanum Street to Fifth Street, west on Fifth Street to the west city limits; and on Manitoba Street from the east city limits west to Pearl Street, north on Pearl Street to Winter Street, west on Winter Street to Water Street, north on Water Street to Second Street, west on Second Street to Kittitas Street, north on Kittitas Street to Fourth Street, west on Fourth Street to Canal Street, northwesterly on Canal Street to Fifth Street, and westerly on Fifth Street to the west city limits.
B. Penalty. Any person violating any of the provisions of this section shall be guilty of a misdemeanor and shall be punished by a fine not to exceed the sum of $300.00. [Ord. 955, 1929; Ord. 939, 1928.]
