5.44.040 Handbills.

A. It is unlawful for any person, firm, or corporation to cause to be posted, thrown or deposited upon any street, alley or public place or in or upon any vehicle thereon in the city of Ellensburg any advertising materials, samples, handbills, dodgers, circulars, booklets, paper or other loose advertising material of any kind and description except newspapers capable of being entered as second class matter under the provisions of United States Post Office regulations. Nothing in this section shall prevent such placing of material described above if performed by an officer, employee or agent of the city of Ellensburg as part of official city business or if separate prior approval has been obtained in each instance and if all other applicable ordinances are complied with.

B. Any person, firm or corporation violating any of the provisions of this section shall be, upon conviction thereof, fined in any sum not exceeding $500.00 or imprisoned in the city jail for a period of not exceeding 90 days, or both, in the discretion of the court.
