5.48.040 Depositing waste on property.
It is unlawful for any person to throw, to drop, or to leave any discarded object, debris, or any waste on any public or private property in the city, or in any waters inside the city unless:
A. The property is designated by the state of Washington or by the city of Ellensburg or any other political subdivisions of the state of Washington for the disposal of garbage and refuse, and the person is authorized to use the property for such purpose;
B. He deposits it in a litter receptacle or container installed on such property;
C. He is the owner or tenant in lawful possession of the property. [Ord. 3493 § 2, 1985.]
5.48.080 Penalty for violation.
Any person violating the provisions of this chapter is guilty of a Class 3 civil infraction, subject to fine not to exceed $50.00. [Ord. 4042 § 1, 1996; Ord. 3493 § 2, 1985.]
