13.22.020 Intent.

The T-C zone is intended to encourage suitable areas for the construction of commercial lodging, service stations, eating and amusement places, and other service establishments servicing primarily traffic existing from the freeways and highways for necessary services. In addition, specific areas of the T-C zone which have a comprehensive plan designation of general commercial may have regional retail commercial uses if the regional retail commercial development criteria in ECC Titles 1, 4 and 13 are met. Regulations are designed to preserve the opportunity for properties in this zone to develop the array of land uses intended to service traffic from the state and federal highways in the immediate area and also allow regional retail commercial developments where deemed appropriate. 13.22.040 Permitted uses.

In the T-C zone, the following uses shall be permitted:

A.    Hotels and motels;

B.    Establishments serving food or beverages;

C.    Commercial recreation establishments;

D.    Retail sales of souvenirs, gifts, novelties, curios, and handicraft products;

E.    Offices;

F.    Public and commercial museums and art galleries;

G.    Gas service stations including truck stop operations, with minor repair work permitted only;

H.    Fruit stands;

I.    Travel trailer parks, providing development and layout is in accord with state statutes and applicable regulations of the State Health Department;

J.    Cocktail lounges;

K.    Taverns;

L.    Public utilities;

M.    Public transportation, deadhead stations;

N.    Adult entertainment establishments, providing they comply with the following:

1.    All such establishments must be at least 1,000 feet from any residential zone, parks, schools, historic district, any dwelling, freeway, highway, interstate, or major arterial (see map on file in the city clerk’s office);

2.    All such establishments must comply with Chapter 13.49 ECC, Adult Entertainment Licenses;

O.    Sales of new automobiles and trucks, and other uses that are both incidental and accessory to such new sales activities including, but not limited to, sales of used automobiles and trucks;

P.    Regional retail commercial development, providing such development complies with the following conditions:

1.    The development property is designated in the city’s comprehensive plan as general commercial land uses;

2.    The development property consists of one parcel, or separate and contiguous parcels (separated only by a public right-of-way), which total area is a minimum of 40 acres in size;

3.    Minimum Project Area for the First Phase of Any Regional Retail Commercial Development.

a.    The proposed development contains a minimum of 100,000 square feet of enclosed gross floor area of commercial uses; provided, that at least 50,000 square feet must be constructed for and used by one retailer.

b.    Development of permitted uses other than regional retail commercial but otherwise allowed in the T-C zone, such as hotel/motel, eating and drinking, office and other uses are not subject to the minimum enclosed gross floor area requirement.

c.    This minimum regional retail commercial enclosed gross floor area may be satisfied by totaling the gross floor areas of separate buildings, if proposed, including buildings separated by a road.

d.    There is no minimum size requirement for subsequent phases of development;

4.    All regional retail commercial development is subject to the design review process set forth in the city’s design standards for regional retail commercial uses contained in ECC 1.45.540(F) and the regional retail commercial master site plan permit requirements;

13.22.060 Conditional uses.

The conditional uses permitted in the T-C zone shall be as follows:

A.    Off-premises signs;

B.    Grocery stores, not to exceed 2,500 square feet gross area;

C.    Public transportation, passenger terminals;

D.    On-site hazardous waste treatment and storage facilities;

13.22.080 Accessory uses.

Accessory uses permitted shall be as follows: accessory buildings, structures and uses customarily incidental to a permitted use, except as otherwise prohibited in this title. [Ord. 2810 § 11.06, 1970.]

13.22.100 Building site area.

Required minimum lot area allowed shall be determined by the aggregate area of the buildings, required yards, off-street parking and loading space and any other specified lot area requirements applicable to the proposed use. [Ord. 2810 § 11.08, 1970.]

13.22.120 Yards.

The following yard requirements shall apply to uses except for regional retail commercial.

A.    Front Yards. There shall be a front yard minimum depth of 15 feet. Off-street parking shall be prohibited in the required front yard.

B.    Rear Yard. Minimum depth of rear yard shall be 10 feet.

C.    Side Yards. On the least side, there shall be a minimum side yard of 15 feet for buildings which measure 35 feet or less in height. All buildings in excess of 35 feet in height must have a minimum side yard setback equal to the height of the building. [Ord. 4497 § 7, 2007; Ord. 3522 § 1, 1986; Ord. 2810 § 11.10, 1970.]

13.22.140 Height limits.

Except for regional retail commercial projects, buildings in excess of 35 feet in height, the maximum building height shall be limited to an amount equal to the smallest side yard setback. For buildings 35 feet or less in height, the total building height shall be independent of the amount of side yard setback. Regional retail commercial project buildings have a building height limit of 50 feet which height limit shall include any building mechanical equipment. 13.22.160 Off-street parking.

Off-street parking facilities as stipulated in Chapter 13.42 ECC shall be provided. [Ord. 2810 § 11.14, 1970.]

13.22.180 Storage.

A.    Outdoor storage of goods or materials normally incidental to permitted uses shall be permitted; provided, that the storage area is screened from public view.

B.    Warehousing or indoor storage of goods or materials beyond that normally incidental to permitted uses shall be prohibited. [Ord. 2810 § 11.16, 1970.]
