13.50.020 Conditions.
The planning commission shall have the power to hear and decide only upon such conditional uses as the commission is specifically authorized to consider by the provisions of this title; to decide such questions as are necessarily involved in determining whether conditional use permits should be granted; and to grant such permits with such conditions and safeguards as are appropriate under this title, or to deny such permits when not in keeping with the purpose and intent of this title. A conditional use permit shall not be granted by the commission unless and until:
A. A written application for a conditional use permit is submitted, indicating the section for this title under which a conditional use permit is sought and stating the grounds upon which it is requested;
B. Notice of public hearing in accordance with the requirements of Chapter 13.56 ECC shall be given;
C. A public hearing shall be held. Any party may appear in person or by agent or by attorney. [Ord. 4028 § 30, 1996; Ord. 2810 § 31.02, 1970.]
13.50.040 Compliance required.
In granting any conditional use permit, the commission may prescribe appropriate conditions and safeguards in conformity with this title. Any conditional use development or activity which does not comply with such conditions and safeguards, as are made a part of the terms under which the conditional use permit is granted, shall be deemed a violation of this title and punishable under ECC 13.64.060. The commission shall prescribe a time limit within which any conditional use shall commence or be completed, or both. Any activity approved as a conditional use under this title shall be developed or commence to be developed within 12 months of the date of approval. Commencement of development activities shall include the issuance of a building permit necessary for physical construction or the actual start of activities covered by the conditional use approval if a building permit is not required. Failure to comply with the time limit shall void the use permit. An extension of the effective period of the conditional use permit may be granted by the commission. 13.50.060 Notification of approval.
A. Upon final approval of an application for a conditional use permit, the city planners shall cause to be sent written notification of the permit approval to both the building official and the applicant. All conditions to be met by the applicant, including but not limited to a required project timetable, shall be stated in the notice.
B. Upon application for the necessary building permits, the applicant shall present a project timetable as required by the planning commission. [Ord. 4028 § 31, 1996; Ord. 3044 § 1, 1975.]
