13.20.010 Basis of utility main charge.

A utility main charge shall be assessed to all new connections which utilize water or sewer mains already existing across the frontage of the property being served. The charges constitute payment to the city for the actual costs incurred in originally constructing the main across the frontage of the subject property. Such charges shall not apply when the affected property participated in a utility local improvement district for the construction of a water or sewer main, nor shall such charges be applicable in cases where the main was built and totally paid for by the owner of the subject property or by any private developer who may still be entitled to reimbursement from abutting owners pursuant to a recorded contract. 13.20.020 Utility main charges.

(1) The utility main charge shall be the actual cost of the main in question at a minimum size of eight inches for water main and at a minimum size of 10 inches for sewer main; however, the size of mains may be increased to adequately serve the subject property/area and said size increase shall be determined by the city engineer. The charge shall be prorated on a front-foot basis.

(2) The city shall keep a record, open to the public, of the prorated construction cost for all city utility mains.

(3) In cases where the city has participated with a private party or utility local improvement district in constructing a main, only that portion of the total costs actually paid by the city shall be used for calculating the utility main charge.

(4) When service is requested to a parcel of property that is subdividable, and service is only desired for a portion of the footage, a minimum frontage of 70 feet shall be used to determine the total front-foot charge. When such parcel is subdivided by either a short or long plat, the balance of the frontage charge shall be paid as a condition of preliminary plat approval.

(5) In addition to the per-front-foot cost reference, the city may assess a charge for any other water or sewer mains constructed with city funds subsequent to 1999. The city shall establish a schedule of fees and a map open to the public at City Hall showing the utility mains which are subject to this charge. The per-front-foot charge for such mains constructed after 1999 shall be administratively calculated by the city engineer; provided, the total of all fees charged on a front-foot basis shall not exceed the total original cost of the project, including all construction, engineering, right-of-way and easement acquisition, and administrative fees.
