9.86.005 Parks – Definition.
The term “park,” as used in this chapter, shall mean any real property located within or outside the city limits of the city of Enumclaw, owned by the city of Enumclaw, which is used by the public for recreation and enjoyment and is posted as a park or a trail. The property assigned and/or used as a trail and as further defined above shall be considered a park for the purposes of this chapter. (Ord. 2246 § 1, 2004).
9.86.010 Hours of operation – Group use.
A. Hours of Operation. The hours of operation of city parks shall be as follows: Parks shall open one-half hour before sunrise and close one-half hour after sunset with the exception of Boise Creek Park which shall stay open until 10:00 p.m. on nights when ball games are scheduled. Hours of operation may be modified for specific activities as approved by the parks and recreation department or city council.
B. Group Use. Any group wishing to use parks or park facilities for political or religious gatherings, concerts or festivals must complete an application form. The parks and recreation director may approve, approve with conditions, or deny. If denied the decision may be appealed by the applicant to the parks board. The criteria for approval shall be noise, pollution, parking, litter and harmony with the surrounding neighborhood. (Ord. 1959 § 1, 1998; Ord. 1214 § 1, 1977; Ord. 1156 § 1, 1975).
9.86.020 Fire restrictions.
No fire shall be allowed in parks other than in approved fireplaces. (Ord. 1214 § 1, 1977; Ord. 1156 § 1, 1975).
9.86.030 Motor vehicle restrictions.
No motor vehicles, including automobiles, trucks, buses, motorcycles and motorbikes, camp trailers, campers or trailers shall be operated in any park except on designated roadways and parking areas. (Ord. 1214 § 1, 1977; Ord. 1156 § 1, 1975).
9.86.040 Liquor.
The consumption of intoxicants is prohibited in all parks in the city. (Ord. 1214 § 1, 1977; Ord. 1156 § 1, 1975).
9.86.050 Animals.
A. Restraint Required. No animals shall be allowed in any park unless under restraint or on a leash no longer than eight feet. All horses shall be confined to those areas designated as roadways, parking areas, or trails. Animal handlers will be responsible for removing their animal waste from parks.
B. Boise Creek Park Scheduled Activities. No animals shall be allowed at Boise Creek Park during any scheduled activity except as an aid to a physically challenged person. A scheduled activity shall include any game, program or special event for which the city of Enumclaw either is the sponsor or has sanctioned. 9.86.060 Camping.
No overnight camping shall be allowed in any park, whether in camper, camp trailer, tent, or otherwise. (Ord. 1214 § 1, 1977; Ord. 1156 § 1, 1975).
9.86.070 Ball playing.
No ball playing shall be allowed in that certain park adjacent to and surrounding the Enumclaw Municipal Building, and no hardball playing shall be allowed in Montgomery Park, except by those of age 12 and younger on the baseball field only. (Ord. 1214 § 1, 1977; Ord. 1156 § 1, 1975).
9.86.080 Parking.
Vehicles must be parked in designated areas only. (Ord. 1959 § 3, 1998).
9.86.090 Golf prohibited.
Golfing is prohibited in city parks. (Ord. 2076 § 1, 2000).
9.86.100 Prohibited motor vehicle use on trails.
It is unlawful for any person to knowingly move on a trail other than by human power, horse power, or electrically powered wheelchair. City-owned vehicles and authorized emergency vehicles as defined in RCW 4.04.040 are exempt from this section. Movement on the trail for the sole purpose of crossing the trail when such movement is made in the most direct and safe manner possible is exempt from this section. (Ord. 2246 § 1, 2004).
9.86.110 Penalties.
A person violating any provision of this chapter shall be punished in accordance with EMC 1.08.010. (Ord. 2246 § 1, 2004).
