5.16.110    Application of Chapter 5.01 FMC.

5.16.010 License – Required.

No person, association or corporation shall engage in the business of hauling or transporting garbage, refuse, rubbish, cans, bottles or other recyclable materials within the city, or in gathering the same within the city for a disposal at some point or area outside the city without obtaining a license therefor, and complying with the laws and regulations of the city, county, state, federal governments in the pursuit of such business. (Ord. 1217 § 31, 1996).

5.16.020 License – Approval or disapproval – Requirements of license.

Within 60 days after submittal of a complete application, the licensing officer shall approve or disapprove the application, based upon the applicant’s ability to provide the collection and disposal service and upon a determination of public necessity for issuance of the requested license. (Ord. 1255 § 12, 1996; Ord. 1217 § 32, 1996).

5.16.030 License – Fee – Term.

The licensee shall pay an annual license fee as set forth in FMC 5.01.110(B). (Ord. 1255 § 13, 1996; Ord. 1217 § 33, 1996).

5.16.040 Payments to city for incurred expenses.

In addition to the annual license fee, the licensee shall be required to pay any and all expenses incurred by the city in relation to garbage, refuse and/or recycling. The expenses so incurred by the city shall be prorated between the licensees in the same ratio as their revenue derived within the city bears to the total of such expenses. (Ord. 1217 § 34, 1996).

5.16.050 Collections.

The licensee shall collect the garbage from residential customers not less than once per week and commercial customers shall be collected daily or as often as required. (Ord. 1217 § 35, 1996).

5.16.060 Tariff schedules – Service rates.

Repealed by Ord. 1255. (Ord. 1217 § 36, 1996).

5.16.070 Required permit.

Repealed by Ord. 1255. (Ord. 1217 § 37, 1996).

5.16.080 Insurance requirement.

Repealed by Ord. 1917. (Ord. 1255 § 16, 1996; Ord. 1217 § 38, 1996).

5.16.090 Disposal of garbage and refuse by licensee.

The licensee shall, at his sole cost and expense, be responsible for disposing of all garbage and refuse and shall pay all dump fees. (Ord. 1217 § 39, 1996).

5.16.100 Cancellation or revocation of license.

The license may be canceled or revoked pursuant to the provisions of this chapter or Chapter 5.01 FMC. (Ord. 1217 § 40, 1996).

5.16.110 Application of Chapter 5.01 FMC.

In addition to the foregoing provisions of this chapter, the applicant and/or the licensee shall be subject to the requirements and criteria set forth in Chapter 5.01 FMC. (Ord. 1217 § 41, 1996).
