16.01.001 Definitions.

As used in this title, unless the context or subject matter clearly requires otherwise, the words or phrases defined in this chapter shall have the indicated meanings. (Ord. 701 § 2, 1996).

16.01.004 Binding site plan.

A “binding site plan” is a plan drawn to scale processed in accordance with the provisions of this title and Chapter 58.17 RCW, which:

A. Identifies and shows the areas and locations of all streets, roads, improvements, utilities, open spaces, critical areas, parking areas, landscaped areas, surveyed topography, water bodies and drainage features and building envelopes; and

B. Contains inscriptions or attachments setting forth such appropriate limitations and conditions for the use of the land as are established by the director, to include those conditions that are part of the original site plan; and

C. Contains provisions requiring any development or division of land to be in conformity with the approved site plan. (Ord. 880 § 2, 2001).

16.01.010 Block.

“Block” is a group of lots, tracts, or parcels within well defined and fixed boundaries. (Ord. 701 § 2, 1996).

16.01.015 Condominium.

“Condominium,” pursuant to RCW 64.34.020(9), means real property, portions of which are designated for separate ownership and the remainder of which is designated for common ownership solely by the owners of those portions. Real property is not a condominium unless the undivided interests in the common elements are vested in the unit owners, and unless a declaration and a survey map and plans have been recorded pursuant to this chapter. (Ord. 915 § 1, 2002).

16.01.018 Building site.

“Building site” means the physical portion of the real property upon which the structures in a binding site plan are situated within one lot, and which portion of the lot satisfies the applicable zoning code standards for physical placement, lot coverage, construction of structures and all other location and dimensional requirements for the dwelling unit. (Ord. 915 § 2, 2002).

16.01.020 Dedication.

“Dedication” is the deliberate appropriation of land or rights in land by its owner for any general and public use, reserving to himself or herself no other rights than such as are compatible with the full exercise and enjoyment of the public use to which the property has been devoted. The intention to dedicate shall be evidenced by the owner by the presentment for filing of a final plat or short plat showing the dedication thereon; and the acceptance by the public shall be evidenced by the approval of such plat for filing by the city. (Ord. 701 § 2, 1996).

16.01.030 Final plat.

“Final plat” is the final drawing of the subdivision and dedication prepared for filing of record with the Pierce County auditor, and containing all elements and requirements set forth in Chapter 16.06 GHMC. (Ord. 1194 § 1, 2010; Ord. 701 § 2, 1996).

16.01.040 Lot.

“Lot” is a fractional part of divided lands having fixed boundaries, being of sufficient area and dimension to meet minimum zoning requirements for width and area. The term shall include tracts or parcels. (Ord. 701 § 2, 1996).

16.01.050 Preliminary plat.

“Preliminary plat” is a neat and approximate drawing of a proposed subdivision showing the general layout of streets and alleys, lots, blocks and other elements of a subdivision consistent with the requirements of this title. The preliminary plat shall be the basis for the approval or disapproval of the general layout of a subdivision. (Ord. 701 § 2, 1996).

16.01.060 Plat.

“Plat” is a map or representation of a subdivision, showing thereon the division of a tract or parcel of land into lots, blocks, streets and alleys or other divisions and dedications. (Ord. 701 § 2, 1996).

16.01.070 Short plat.

“Short plat” is the map or representation of a short subdivision. (Ord. 701 § 2, 1996).

16.01.080 Short subdivision.

“Short subdivision” is the division or redivision of land into four or fewer lots, tracts, parcels, sites or divisions for the purpose of sale, lease, or transfer of ownership into four or fewer lots. (Ord. 701 § 2, 1996).

16.01.090 Subdivision.

“Subdivision” is the division or redivision of land into five or more lots, tracts, parcels, sites or divisions for the purpose of sale, lease, or transfer of ownership, except as provided in Chapter 16.03 GHMC. (Ord. 701 § 2, 1996).
