2.06.010 Definitions

“Public meeting” means a meeting of a town governing body or advisory board, commission, committee, or other body subject to the provisions of the Open Meetings Act, Chapter 42.30 RCW.

“Publicly owned” means lands, structures, and facilities within the limits of the town of Index and owned by a public or government entity, including but not limited to the town of Index, SCFPD No. 26, and Index School District No. 63. “Publicly owned” also means street and alley rights-of-way as platted, whether or not developed as open thoroughfares. (Ord. 502 § 1, 2023).

2.06.020 Meetings to be held on publicly owned premises.

All public meetings of the Index town council, the Index planning commission and any other such commissions, boards, or committees hereinafter established by the town, to which the requirements of the Open Meetings Act, Chapter 42.30 RCW, apply, shall be held on premises which are publicly owned. (Ord. 502 § 2, 2023).

2.06.030 Funds not to be expended for private meeting locations.

No funds, including but not limited to site rental charges, and consultant or speaker fees shall be appropriated or expended by the town for the purpose of holding public meetings in locations which are not publicly owned. (Ord. 502 § 3, 2023).

2.06.040 Conditions of exceptional circumstance.

In circumstances of unforeseen emergency, where all suitable publicly owned venues are unsafe or unavailable, the Index town council may conduct an emergency meeting under applicable law and authorize by resolution acceptable alternate meeting locations for the duration of the emergency.
