16.48.010 Purpose.

The purpose of this chapter is to provide a process for the division of land for the purpose of sale, lease or transfer of commercial or industrial lots, as an alternative to the subdivision or short plat process as authorized by RCW 58.17.035. (Ord. 3699 § 1 (Att. A), 2009; Ord. 3092 § 1, 1988)

16.48.020 Scope.

Any land designated for the sale or lease of commercial or industrial designated lands, or for lease of lands where no residential structure other than manufactured homes or travel trailers are permitted, shall, upon receipt of a binding site plan application by the city, be considered for exemption from the standard long-plat and short-plat subdivision requirements; provided, that such lands meet and conform to the procedures and requirements of this chapter. 16.48.030 Application requirements.

A. Application for a binding site improvement plan shall be made with the community development department on the prescribed forms. The application shall be accompanied by seven copies of the preliminary site improvement plan on a sheet or sheets having dimensions no larger than twenty-four by thirty-six inches.

B. The preliminary site improvement plan shall conform to the following requirements:

1. The preliminary plan shall be a neat and accurate drawing by a land surveyor on reproducible material and shall be drawn at a convenient scale (one inch equals one hundred feet);

2. The preliminary plan shall include a vicinity map showing the location of the site and its relationship to the surrounding area;

3. The preliminary plan shall identify the location and dimensions of all existing and proposed streets, roads, sidewalks, improvements, utilities, and open spaces;

4. The preliminary plan shall show land contour lines illustrating topography as follows:

C. The application shall be accompanied by a nonrefundable fee in such amount as is established by resolution of the city council.

D. Environmental information shall be prepared and submitted in accordance with the guidelines established under the State Environmental Policy Act of 1971, as amended, and Title 18, as may be amended after the effective date of the ordinance codified in this chapter. Such information is part of and must accompany the binding site improvement plan application.

E. Notice of the application shall be made according to Title 18B. (Ord. 3699 § 1 (Att. A), 2009; Ord. 3092 § 3, 1988)

16.48.040 Alternative review procedures.

An application for a binding site improvement plan shall be processed in a similar manner as a subdivision as a Type IV land use action as specified in Title 18B. (Ord. 3699 § 1 (Att. A), 2009; Ord. 3092 § 4, 1988)

16.48.050 Required improvements.

Prior to final approval of any binding site improvement plan, the review authority shall ensure that the following improvements are provided to service the anticipated uses throughout the proposed site:

A. Landscaping, as required by Title 17;

B. Parking, as per requirements of Title 17, zoning;

C. Water supply (potable, plus firefighting flow level);

D. Sewage disposal;

E. Storm drainage improvements;

F. Fire hydrants;

G. Sidewalk access to all anticipated uses within the site;

H. Street and parking lot lighting and landscaping;

I. Provision for all appropriate deed, dedication, and/or easements;

J. Location of all permanent monuments on all exterior tract corners. (Ord. 3699 § 1 (Att. A), 2009; Ord. 3092 § 5, 1988)

16.48.060 Approval of overall binding site improvement plan.

A. The final site improvement plan shall be drawn in black ink on a sheet of mylar having dimensions of twenty-four by thirty-six inches, or approved substitute. If more than one sheet is required, the sheets shall be numbered and indexed. The scale may range from fifty feet to the inch to two hundred feet to the inch. All signatures on the mylar and recorder’s plat sheet shall be originals.

B. Prior to the final site plan being approved, it shall be revised to accurately reflect all required improvements and shall include all applicable inscriptions deemed necessary by the director of community development setting forth such appropriate limitations and conditions for the use of the land.

C. The final binding site plan shall bear all signatures and seals as required under the city’s subdivision ordinance.

D. Binding site improvement plans shall be filed by the applicant with the county auditor, and a copy of the recorded instrument shall be returned to the community development department prior to the issuance of any building permits for construction on any land within the site. The applicant shall pay all costs associated with this filing. (Ord. 3699 § 1 (Att. A), 2009; Ord. 3092 § 6, 1988)

16.48.070 Construction site—Building permit requirements.

A. Prior to issuance of any building permit for construction within an approved binding site improvement plan, that portion of the plan for which the building permit is requested must be legally described and receive a certificate of segregation from the community development department.

B. Prior to the issuance of a building permit for construction within a binding site improvement plan, all required improvements needed to adequately service that portion of the plan for which the building permit will be issued shall be installed or bonded one hundred fifty percent of the estimated cost.

C. Any site construction plan submitted for lands within a binding site plan having all necessary public utilities in place and functional is exempted from the formal public review process. (Ord. 3699 § 1 (Att. A), 2009; Ord. 3092 § 7, 1988)

16.48.080 Revision of plan.

Alteration of an approved and recorded binding site improvement plan shall be accomplished by application procedure as set forth in Chapter 16.16. (Ord. 3699 § 1 (Att. A), 2009; Ord. 3092 § 8, 1988)

16.48.090 Appeal procedures.

Appeals of actions under this chapter shall be conducted in accordance with Title 18B. (Ord. 3699 § 1 (Att. A), 2009; Ord. 3171 § 8, 1991; Ord. 3092 § 9, 1988)
