3.60.003 Returned check fee.

Any and all checks and ACH rejects returned to the town of La Conner as a result of nonsufficient funds, account closure or other reasons that incur a cost to the town shall be assessed a penalty of $25.00. [Ord. 1157 § 1, 2017; Ord. 940 § 1, 2004.]

3.60.005 Town supported events.

The following events may utilize town facilities free of any charge for rental: Arts Alive reception and show, the La Conner Firemen’s Association Saint Patrick’s dance/fundraiser, the Skagit River Poetry Festival (excluding fundraisers), Fiberfest sponsored by the Quilt Museum, the annual Skagit County Historical Museum fundraiser, the annual Tulip Ambassador selection, and the annual La Conner Library District fundraiser. These event sponsors shall be responsible for any fees incurred by the town for cleaning of facilities or repair of damage following the event.

Additionally, for events authorized and supported by the La Conner arts commission or La Conner park commission, for the benefit of the community, town facilities may be utilized free of any charge for rental or cleaning; provided, that the event is a La Conner arts commission or La Conner park commission sponsored event and arts or park commission members are on site and responsible for the facilities during the event. 3.60.007 La Conner Chamber events.

Town facilities may be utilized free of rental charges by the La Conner Chamber of Commerce for the annual Bird Festival, Ice Cream Social, and Brew on the Slough. Any fees incurred by the town for cleaning of facilities or repair of damage will be billed to the Chamber for reimbursement. Article I. Maple Hall and Maple Center

3.60.010 Fee schedule.

(1) Rental fees for town facilities shall be established by resolution of the town council.

(2) The town of La Conner will waive rental and equipment fees (excluding cleaning fees) for La Conner Rotary’s use of Maple Hall/Center for the following four community events per year:

(a) Annual dinner auction: two-day use.

(b) Santa Breakfast in December: one-day use.

(c) Two additional events to be determined such as a movie night: one-day use.

La Conner Rotary will submit a reservation schedule for the four events on or before January 15th of each year.

(3) The town council will establish written policies for the use of Maple Hall/Center that are not inconsistent with the provisions of this chapter. Such policies may address, but are not limited to, alcohol service at events, insurance provided by event organizers, and hours of operation for events. 3.60.040 Audio/visual equipment.

3.60.050 Theatre/performing arts groups.

(1) Rates. Rates for authorized theatre/performing arts groups shall be set by the mayor on a case-by-case basis and may be based upon the number of tickets sold for the event or a set flat fee. The rate includes the performance(s) and any related rehearsals. The mayor shall take into account when setting the fees the following criteria:

(a) The number of shows;

(b) The number of days the hall is utilized altogether;

(c) Whether or not alcohol and/or food are served as part of the performance;

(d) Past experiences with a particular theatre group; and

(e) Whether or not the theatre group is performing as part of a for-profit enterprise.

The mayor shall set the fee in accordance with the purpose of Maple Hall which is to encourage performing arts.

(2) Eligibility. To be eligible to receive the rates for theatre/performing arts groups, the person, group or organization must submit a request to and receive approval from the mayor. [Ord. 1078 § 4, 2012; Ord. 1041 § 11, 2010; Ord. 770 §§ 2, 3, 2000.]

3.60.060 Cleaning fees.

Article II. Public Works Fees

3.60.070 Storm drainage fees.

Permit review, inspection, and installation fees shall be charged and paid in advance in accordance with the most current resolution establishing such fees as adopted by the La Conner town council. In addition, the following fees shall be charged and paid in advance for storm drainage:

3.60.080 Time and material charges.

The following fees shall be charged and paid in advance based on a written estimate from the public works director or his or her designee:

(a) Cancellations within 60 days of the event will result in forfeiture of 50 percent of the deposit. Cancellations within 30 days of the event will result in forfeiture of the full deposit.

(b) Reservations shall be made on a first come, first serve, written application basis only through Town Hall. The rental application, deposit, and proof of residency within La Conner School District boundaries (if applying for the resident rate) must be submitted, and 50 percent of the rental fee paid within 48 hours, to bind and hold the event date. The remaining balance of the rental fee and the deposit shall be due 60 days prior to the event.

(c) To qualify for the resident rate, the person signing the rental agreement must show proof of residency within the La Conner School District boundaries. Businesses or organizations applying for the resident rate must show proof that their business office is located within La Conner School District boundaries.

(d) Any event with alcohol and/or dancing will be required to provide an approved safety and security plan at the time of application. Safety and security plans must be approved by town staff and law enforcement.

(e) If damages exceed the amount of deposit, renter will be notified. Renter agrees to pay any damages that exceed the amount covered by the damage deposit.

(f) At the discretion of the mayor and the La Conner town council facilities committee, the fee for use of the Garden Club may be reduced or waived upon written request if the request meets one or more of the following criteria:

(i) The event provides specific economic benefit to the town as a whole; and/or

(ii) The event has cultural or historic significance to the town; and/or

(iii) Educational benefit;

(iv) If the facility is not rented less than 48 hours from a date.

No applicant will qualify for a reduced rate if a fee or donation is required for admission.
