7.45.010 Purpose.

The purpose of this chapter is to prevent the use of firearms and dangerous weapons which pose a threat to the general public, animals and property within the corporate town limits of La Conner. [Ord. 1012 § 2, 2008.]

7.45.020 Definitions.

“Projectile” means any arrow, pellet, shot, knife, ax, spear or other device capable of being shot or thrown in a way that can create bodily harm to a person, animal or property. [Ord. 1012 § 2, 2008.]

7.45.030 Firearms – Prohibited use.

It is unlawful for any person, persons or combination of persons to discharge, fire or detonate any firearm, or to set or cause any explosion of any kind within the corporate town limits; provided, that this section shall not apply to the following persons or activities:

(1) A person acting in self defense.

(2) Law enforcement personnel while engaged in official duties.

(3) Use of display fireworks permitted by Chapter 7.25 LCMC. [Ord. 1012 § 2, 2008.]

7.45.040 Dangerous weapons – Use regulated.

(1) It is unlawful for any person, persons or combination of persons to shoot or throw any dangerous weapons, including but not restricted to bows and arrows, crossbows, slingshots, knives, axes, spears or air rifles, capable of bodily harm to any person, animal or property within the corporate town limits except for the following uses:

(a) Law enforcement purposes.

(b) Classes conducted on the grounds of a public school with the approval of the agency administering the site of the activity.

(c) On private property with the express permission of the owner or owners with the following provisions:

(i) The placement of a natural or manufactured backstop of sufficient size to ensure capture of inaccurate or accidentally discharged arrows or any other projectile.

(2) It shall also be unlawful for any person, persons or combination of persons to shoot or throw a projectile from any point onto private or public property unless authorized by the owner of the property onto which the projectile is shot or thrown and the conduct is permissible under the terms of this section. 7.45.050 Violation – Civil penalty.

A violation of this chapter shall be a civil infraction for which a civil penalty may be imposed pursuant to the provisions of this chapter. [Ord. 1012 § 2, 2008.]

7.45.060 Penalty.

It shall be an infraction for any person or persons to violate a provision of this chapter; any such person or persons shall be liable for a civil penalty of $1,000. [Ord. 1012 § 2, 2008.]

7.45.070 Judicial appeal.
