5.72.010 Definitions.

(1) “Operate” and all of its derivatives as used herein, means the broadcasting of amplified sound.

(2) “Sound truck”, as used in this chapter, means any vehicle, carriage or fixture, movable or stationary, in or on which shall be installed or carried any device for amplifying sound for advertising purposes, except radio receivers installed and used for the exclusive use of the occupants of vehicles in which the same shall be installed. (Ord. 398 § 1, 1941).

5.72.020 License – Required.

It is unlawful for any person to operate any sound truck on any of the streets or public ways of the city without having first procured a license and paid a fee for the operation thereof from the city clerk. (Ord. 2127 § 1, 1983).

5.72.030 License – Fee.

The license fee for the operation of any sound truck on any of the streets or public ways of the city shall be $5.00 for any calendar month or portion thereof. (Ord. 2127 § 1, 1983).

5.72.040 License fees additional to other business taxes.

The license fees hereinbefore provided shall be in addition to any business tax which may be required by any other ordinance of the city in the event said sound truck shall for compensation be used for the purpose of advertising business of anyone other than the owner of said sound truck. (Ord. 398 § 2, 1941).

5.72.050 Hours of operation.

(1) No sound truck shall be operated on any of the streets or public ways within any of the residential or apartment areas of the city as defined by LMC Title 19, except between the hours of 2:00 p.m. and 7:00 p.m. on any day, and then only while said sound truck is in motion at a rate of speed of not less than five miles per hour.

(2) Within the commercial area and manufacturing district of the city, as defined by LMC Title 19, duly licensed sound trucks may be operated at other hours than those above if approved by the police chief.

(3) Sound trucks may be operated not more than two days per week. No sound truck may be operated on Sunday. (Ord. 2127 § 1, 1983).

5.72.060 Provisions of operation.

Notwithstanding anything hereinbefore provided, the city clerk shall be authorized to grant a license to operate a sound truck only when the city manager shall notify the city clerk in writing that such operation, under such conditions as may be imposed by the police chief, will not cause undue disturbance to the comfort and repose of a substantial number of people in the area where the sound truck is authorized to be operated.
