19.69.010 Building site calculations.

In calculating the area of building sites or required open spaces, no such area or required open space shall be considered as serving two buildings or as serving an existing building and a building to be erected; it being the purpose and intent of this title that every building or structure whether erected heretofore or hereafter shall not have the yards or site areas reduced below the standards herein required. (Ord. 1334, 1967).

19.69.020 Ownership divided by a district boundary line.

If a district boundary line cuts a lot of record, having a single ownership prior to April 13, 1967, in such a manner that the property so cut has one or more parcels of different classifications, then each such parcel having an area of less than 4,800 square feet or an average width of less than 40 feet may take the same classifications as the adjoining larger parcel of the same ownership. (Ord. 1334, 1967).

19.69.030 Certificate of occupancy.

(1) No vacant land shall hereafter be occupied or used nor shall the use of a building be changed from a use limited to one district to that of any other district as defined by this title until a certificate of occupancy has been issued by the building inspector, excepting that the use of vacant land for gardening, the growing of farm produce or for grazing purposes, excepting as otherwise restricted by the city ordinances, shall not be governed by the provisions of this subsection.

(2) Land. Certificate of occupancy for the use of vacant lands or the change in the use of land as herein provided shall be applied for before any such land shall be occupied or used and a certificate of occupancy shall be issued within 10 days after the application has been made, providing such use is in conformity with the provisions of these regulations.

(3) Nonconforming Uses. Upon a written request of the owner, the building inspector shall issue a certificate of occupancy for any building or land existing on May 21, 1967, certifying, after inspection, the use of the building or land and whether such use conforms to the provisions of this title or not.

(4) Applications for a certificate of occupancy for a nonconforming building shall be accompanied by a plot plan as required with the applications for building permits. (Ord. 1334, 1967).
