CHECKS AND DRAFTS

3.40.010 Dishonored checks and drafts.

A service or handing fee as established from time to time by resolution of the city council shall be assessed against any person giving the city what is commonly known as an “NSF” check or draft or giving the city a check on or a draft on an account which is closed. An “NSF” check or draft is a check or draft dishonored by the bank upon which it is drawn because the account contains insufficient funds to cover the check or draft.

3.40.020 Assessment in addition to other fees.

The service or handling charge set forth in Section 3.40.010 shall be in addition to other fees, penalties, and charges that accrue until payment is made in cash.

3.40.030 Service or handling fee, charge on utility accounts.

Any service or handling fee set forth in Section 3.40.010 which is assessed as a result of the receipt of a check or draft for payment of a utility account may be added to the utility account.

3.40.040 Refusal of checks or drafts.

Any department of the city may refuse to accept checks or drafts from any persons who have previously given “NSF” checks or drafts or checks or drafts which are drawn on accounts which are closed in payment for city services.

3.40.050 Remedy not exclusive.

Imposition of the service or handling fee set forth in Section 3.40.010 shall not preclude the city from pursuing other remedies available to the city including but not limited to those available under RCW Title 62A and Title 9A as a result of the issuance of the “NSF” check or draft.
