9.28.010 Purpose and intent.

Locating containers formerly used for transporting sea-going cargo, railroad cars and cabooses, semi-trailers when intended to be used as storage facilities, or any other unit which slides off a chassis or frame when intended to be used as storage facilities in a residential neighborhood and in a commercial neighborhood, is contrary to the best interests and welfare of the citizens of the town, as such containers, railroad cars and cabooses, semi-trailers when intended to be used as storage facilities, and other trailers when intended to be used as storage facilities, or other units which slide off chassis or frames when intended to be used as storage facilities were not constructed or intended to be located in residential neighborhoods and in commercial neighborhoods and used as a type of storage facility. If placed and located in residential neighborhoods and in commercial neighborhoods, such placement could have a negative and deleterious effect on surrounding property values and the well-being of the residents living in and near the affected neighborhoods.

9.28.020 Prohibiting permanent placement of containers and similar structures within the town.

No person, partnership, joint venture, or corporation shall permanently locate any container formerly used for transporting sea-going cargo, railroad cars, cabooses, semi-trailers when intended to be used as storage facilities, or any other unit which slides off a chassis or frame including a body, box or unit which is removed from a chassis when intended to be used as storage facilities on any property within the town.

9.28.030 Temporary placement of containers and similar structures within the town upon a conditional use permit.

No person, partnership, joint venture, or corporation shall temporarily locate any container formerly used for transporting sea-going cargo, railroad cars, cabooses, semi-trailers when intended to be used as storage facilities, or any other unit which slides off a chassis or frame including a body, box or unit which is removed from a chassis when intended to be used as storage facilities on any property in the town, without first applying for and obtaining a conditional use permit from the planning commission of the town. Such permit will be issued only for temporary use of such containers for storage in connection with a bona fide construction project for a period of not more than ninety days. Such conditional use permit may be extended for an additional period of not more than ninety days upon application to the planning commission and upon a showing of necessity that additional time to use the container is required by the construction project; but in no event shall the container or other storage facility be used for a period of more than one hundred eighty days at any location in the town.

9.28.040 Containers now located in the town.

Containers formerly used for transporting sea-going cargo, railroad cars and cabooses, semi-trailers when intended to be used as storage facilities, or any other unit which slides off a chassis or frame including a body, box or unit which is removed from a chassis which is intended to be used as a storage facility, which are already in place and located in the town, the location and placement of which are in violation of this chapter, may be allowed to remain in place upon such conditions imposed by the planning commission including but not limited to conditions to insure the adjoining property owners and the public are screened from any unsightly placement of such a device, and keeping in mind the efforts of the town to improve the visual appearance of the town. If the use of such device is discontinued, it shall not again be permitted at the same location, unless on a temporary basis as hereinabove provided.

9.28.050 Violation-Penalty.

Failure to comply with any provision of this chapter shall subject the violator to a penalty of up to thirty-seven dollars and fifty cents per day for each day the violation continues.
