16.12.010 Compliance.

It is unlawful for any person or persons to use or discharge any explosive substance within the city limits, for the purpose of blasting earth, stone, trees, stumps or logs, without first complying with the provisions of this chapter. (Ord. 94, 1911; Ord. 39, 1905).

16.12.020 Permit required.

Any person or persons wishing to blast any earth, stone, trees, stumps or logs within the city limits shall first procure a permit from the city clerk to do such blasting. (Ord. 94, 1911; Ord. 39, 1905).

16.12.030 Requirements for permit – Bond.

When any application for a permit to do any blasting as mentioned in MMC 16.12.020 is made to the city clerk, before issuing a permit therefor, he shall satisfy himself that the blasting to be done can be done without endangering the person or property of any of the inhabitants of the community in which the blasting is to be done and that the person making application to do such blasting is financially responsible to make good any damages that may be incurred through any fault or negligent act of his, in connection therewith, or if he is not financially responsible, then and in that case, a bond in the sum of three hundred dollars running to the city of Monroe, with sureties to be approved by the clerk shall be furnished, conditioned that such applicant shall pay or cause to be paid, any and all damages caused to any person or property by such blasting; and then if the city clerk shall be satisfied that the person or persons so applying for a permit will in good faith comply with the provisions of this chapter, a permit shall be issued therefor by the city clerk; provided, that such permit shall in all cases direct that such blasting shall be done under the inspection of the chief of police of the city or some other suitable and qualified person to be named and appointed by him, to inspect such blasting, which inspector shall be paid by the person making application for such permit. 16.12.040 Inspection.

As soon as any permit shall have been issued in accordance with the terms of this chapter, the same shall be presented to the chief of police, who shall, unless he chooses to inspect such blasting himself, appoint a suitable person as inspector for the work of inspecting such blasting to see that the same is done in such a manner as not to endanger the person or property of any person or persons in the community where such blasting is to be done and it shall be the chief’s duty or the duty of such person so appointed to prevent any blasting being done unless in his judgment the proper means of safety and the necessary precautions are taken to protect the persons and property in the community where such blasting is to be done. 16.12.050 Responsibility for damage.

Any person doing any blasting of any earth, stone, trees, stumps or logs within the city, shall be held absolutely responsible for any and all damages caused to any and all persons or property by reason thereof. (Ord. 94, 1911; Ord. 39, 1905).
