5.40.010 License required.
Hereafter it shall be unlawful for any person, or persons, company, corporation or association to do, transact, exercise, engage in, or carry on either directly or indirectly, within the corporate limits of the City of Mountlake Terrace, Washington, any trade, occupation, business or activity for which a license is required, or a license fee provided, as hereinafter specified, without first procuring such license and making payment of such fee. 5.40.020 Definitions.
A. “Carnival” means every device, institution (if only one such device or institution is operated) or assemblage of such devices or institutions the purpose whereof is to provide entertainment, amusement, sport, pastime or merriment for the patrons thereof, and shall include roller coaster, merry-go-round, swing, ferris wheel, games of shooting, throwing, chance, pitching, phenomenal exhibitions and everything of like character for admission to which a fee is charged.
B. “Circus” means any institution whose general occupation is that of exhibiting wild or trained animals, feats of horsemanship, animal stunts and acrobatic or aquatic sports for admission to which a fee is charged. (Ord. 282 § 1, 1962).
5.40.030 License fee.
The proprietor or manager of every carnival or circus shall pay a license fee as set forth in the Business License Ordinance of the City of Mountlake Terrace currently in force. (Ord. 1030, 1975; Ord. 282 § 2, 1962).
5.40.040 Application.
Before any person shall operate a carnival or circus in the City of Mountlake Terrace, application for license shall be made to the City Clerk on forms provided. All such applications shall be subject to investigation by and approval by the City Manager. However, no license shall be required for any circus or carnival conducted entirely within the confines on any publicly owned building or grounds. (Ord. 282 § 3, 1962).
5.40.050 Insurance – Law enforcement – Sureties.
A. Before any person shall operate any circus or carnival licensed under the provisions hereof, he shall furnish a copy of a current insurance policy including coverage for property damage and personal injury of not less than $150,000 per person and $300,000 per accident, including indemnity for the City of Mountlake Terrace as an additional insured under such policy.
B. The operator of any carnival or circus having more than five separate rides, devices, or institutions as defined in MTMC 5.40.020, for which admission charges are made shall provide for the assignment of law enforcement personnel consisting of two on-duty police officers provided by the City of Mountlake Terrace to be on duty during the time the carnival or circus is open for business, the cost of which shall be paid for by the operator. The operator shall pay in cash or certified check to the City of Mountlake Terrace, no later than 24 hours after final operation of the circus or carnival, the amount designated by the Police Chief or his designee as the total cost of extra law enforcement personnel as hereinabove set forth. The operator shall also be required to deposit with the City Clerk cash or surety bond with sureties to be approved by the City in the amount of $250.00 to be held by the City of Mountlake Terrace for a period of 15 days after the last day of operation to guarantee payment of costs, if any, for damage to streets or other public owned areas as a result of the operation of the aforesaid carnival or circus, or for such other costs, including the assignment of police personnel as may be occurred. 5.40.060 Violation – Penalty.
Any person, firm or corporation who violates any of the provisions of this chapter shall be guilty of a misdemeanor and upon conviction thereof shall be punished by a fine in any sum not to exceed $250.00. (Ord. 1030, 1975; Ord. 282 § 5, 1962).
