6.40.010 Authority.

The police chief shall be responsible for enforcing the provisions of this chapter, and may promulgate such rules and regulations as necessary to implement and administer this chapter. The animal control authority shall be empowered to exercise this chapter, including the issuance of citations. Persons enforcing this chapter shall display appropriate identification reflecting their authority. (Ord. 1480 § 1, 2023; Ord. 1105 § 2 (part), 2004)

6.40.020 Authority to enter premises.

The animal control authority is authorized to enter upon any lands for the purpose of seizing or impounding any animal running at large thereon or that constitutes a threat or hazard to the safety of any person or animal, or for the purpose of enforcing any provision of this chapter. The animal control authority shall not be liable for trespass for any such entry. (Ord. 1105 § 2 (part), 2004)

6.40.030 Third party liability.

It is expressly the purpose of this chapter to provide for and promote the health, safety, and welfare of the general public and not to create or otherwise establish or designate any particular class of group of persons who will or should be especially protected or benefited by the terms of this chapter. It is the specific intent of this chapter that no provisions nor terms used in this chapter are intended to impose any duty whatsoever upon the city or any of its officers or employees, for whom the implementation and enforcement of this chapter shall be discretionary and not mandated. 6.40.040 Nonliability.

Nothing contained in this chapter is intended to be, nor shall be, construed to create or form the basis for any liability on the part of the city, or its officers, employees or agents, for any injury or damage resulting from the failure of any person to comply with the terms of this chapter, or by reason or in consequence of any omission in connection with the implementation or enforcement of this chapter on the part of the city by its officers, employees or agents.
