9.12.010 Assault in the fourth degree.

A.    Every person who commits an assault not amounting to an assault in either the first, second or third degree, as provided by Chapter 9A.36 RCW, is guilty of assault in the fourth degree. A criminal assault is an attempt, whether completed or not, with unlawful force, to inflict bodily injury upon another, accompanied with the present ability or the appearance of the present ability, to give effect to the attempt if not prevented. Assault does not require a visible injury and includes an unlawful touching of another. Assault in the fourth degree shall be a gross misdemeanor.

B.    Self-defense shall be a complete defense to assault in the fourth degree. It shall be a defense to the charge of assault in the fourth degree if the action was committed in self-defense or defense of another; provided, that any defense must be reasonable and necessary. Every person who, by action, words, signs or gestures, wilfully provokes, or attempts to provoke another person to commit an assault or breach of the peace is guilty of a misdemeanor. (Ord. 398 § 6.02, 1982)

9.12.050 Assault in the fourth degree against children.

A.    Every adult who commits an assault not amounting to an assault in either the first, second, or third degree as provided in Chapter 9A.36 RCW and commits such assault against a child, as defined in RCW 26.44.020, is guilty of assault in the fourth degree against a child.

B.    RCW 9A.16.100, which is adopted in Section 9.08.010 of this title by reference, shall be a defense to this charge. Violations of this chapter shall constitute a gross misdemeanor and be subject to the provisions contained in Mukilteo Municipal Code Chapter 1.32, General Penalties.
